CITY OF LINO LAKES <br />RESOLUTION NO. 04-51 <br />RESOLUTION DENYING VARIANCES <br />FOR LOT AREA AND LOT WIDTH, 1612 BIRCH STREET <br />WHEREAS, a request has been submitted to the City for the approval of variances for lot area <br />and lot width to allow a minor subdivision at 1612 Birch Street, and <br />WHEREAS, review and approvals of variances are governed by state statutes and City <br />ordinances, and <br />WHEREAS, the Lino Lakes City Council makes the following findings: <br />a. The property in question can be put to a reasonable use if used under conditions allowed by <br />the official controls. The site is being used for a single family home. Under the current <br />comprehensive plan, the site will be eligible for development and MUSA after year 2010. <br />b. The plight of the landowners is not due to physical circumstances unique to his property not <br />created by the land owner. The lot was created in year 2000, the result of splitting 40 acres <br />into 15 acres and 25 acres. The site is rectangular and developable in the time frame laid out <br />by the comprehensive plan. <br />c. The variance request is based on economic considerations. <br />d. Granting the variance requested will confer on the applicant special privilege that would be <br />denied by this ordinance to other lands, structures, or buildings in the same district. <br />e. The proposed actions will not be in keeping with the spirit and intent of the ordinance. The <br />Rural district purposes include the statement that the district is designed and intended to aid <br />in guiding development toward fulfillment of the Comprehensive Plan and to serve the <br />following functions: <br />1. To preserve productive land for agricultural use and maintain "open space" within and <br />near to urban areas. <br />2. To help guide development of urban and rural areas along an orderly design to preserve <br />continuity and efficiency of service. <br />3 To provide a method by which the urban farm can be guided so as to control urban <br />sprawl and still conserve land in an economic status until such time as the need is present <br />for an amendment to the Comprehensive Plan. <br />4. To reduce the possibilities of rural-urban conflicts in establishing types and levels of <br />service, methods of financing the services and needs. To maintain an acceptable per <br />capita cost for such services as sanitary sewer, water, police, fire, road maintenance, <br />school transportation, and other necessary services. <br />
