CITY OF LINO LAKES <br />RESOLUTION NO. 04-65 <br />RESOLUTION DENYING VACATING ROAD EASEMENT REQUEST, <br />1390 KARTH ROAD, EQUITY ESTATES <br />WHEREAS, the City Council of Lino Lakes hereby denies the request to vacate <br />the 30' Road Easement at 1390 Karth Road in Equity Estates, in its entirety, from its <br />intersection with Karth Road to the south property line of said parcel; and <br />WHEREAS, a public hearing was held on May 10, 2004 before the City Council <br />in the City Hall Council Chambers after due published and posted notice had been given <br />on April 20, 2004, and a reasonable attempt was made to give personal notice to all <br />affected property owners, and all persons interested were given an opportunity to be <br />heard; and <br />WHEREAS, it appears to be in the best interest of the City to keep such road <br />easement; and <br />WHEREAS, three -fifths of all members of the City Council concur in this <br />resolution. <br />NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br />Section 1. That the 30' Road Easement vacation request, as dedicated on the Plat of <br />Equity Estates, Anoka County, Minnesota, is hereby denied. <br />Section 2. That any person, corporation or city owning or controlling easements <br />contained upon the property reserves the right to continue to maintain, repair, replace, <br />remove or otherwise attend thereto. <br />Adopted by the Lino Lakes City Council this 10th day of May, 2004. <br />ATTEST: <br />Ann .: l . ir, City Clerk <br />• <br />J ergeson, Mayor <br />
