MEETING DATE: June 14, 2004 <br />TOPIC: Resolution 04 -84: Denying Application for <br />• Comprehensive Plan Amendment <br />• Rezoning <br />• Allocation of MUSA Reserve <br />• Preliminary Plat <br />Fox Den Acres <br />VOTE: 3/5 <br />BACKGROUND <br />Royal Oaks Realty has requested approval of single family residential development called Fox <br />Den Acres. The comprehensive plan guides the majority of the site for low density residential <br />use and it is zoned R -1. The request includes an amendment of the comprehensive plan, <br />rezoning, MUSA reserve allocation, and a preliminary plat. This would allow the development <br />to extend beyond the boundary of the area currently guided for development to provide for an <br />additional eight lots. <br />There are several challenging design issues including a "ponding and flowage" easement, single <br />access point due to past development designs, the growth management policies, and wetlands. <br />The City must consider these issues in the project design while acknowledging that most of the <br />property is guided and zoned for development, and has been for some years. There is usable <br />upland outside of the growth boundary and the applicant wishes to utilize this upland. <br />To accommodate the proposal, the following approvals are necessary: <br />1. Comprehensive Plan Amendment for areas outside current Low Density Sewered <br />Residential and Stage 1 growth areas <br />2. Rezoning of areas outside current R -1 zone, from Rural to R -1 <br />3. Allocation of MUSA Reserve to areas outside current growth boundary <br />4.
