• <br />• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 04-89 <br />FINDING TWO VIOLATIONS OF LIQUOR CODE AND IMPOSING PENALTY <br />FOR THE OASIS MARKET <br />WHEREAS, the Police Department of Lino Lakes conducted compliance checks on <br />liquor establishments on October 25, 2003 and also on April 23, 2004; <br />WHEREAS, it was alleged that the Oasis Market violated Ordinance 701 by selling <br />alcohol to a person underage on these two occasions; <br />WHEREAS, the City Council of Lino Lakes conducted a violation hearing on June 14, <br />2004 at 5:30 p.m. and reached a finding that these violations did occur; <br />WHEREAS, the City Council has agreed to impose penalties consistent with the Best <br />Practices Grid; <br />WHEREAS, the recommended penalty under the Best Practices Grid is as follows: <br />1. $1,500 Financial Penalty <br />2. 10 days suspension, stayed. (Suspension imposed and revert to Non -Best <br />Practices Grid if third violation). <br />3. Require all employees who serve liquor to attend server training <br />4. Mandatory liquor code handbook to be available to all employees at all times. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LINO LAKES, MINNESOTA: <br />The City of Lino Lakes hereby adopts Resolution No. 04 -89 Finding Two Violations of <br />the Liquor Code and Imposing Penalty for the Oasis Market. <br />Adopted by the Council of the City of Lino Lakes this 14th day of June, 2004. <br />Ann Blair, City Clerk <br />
