• <br />• <br />AGENDA ITEM 1B <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: August 23, 2004 <br />TOPIC: Consider Resolution 04 -124 Approving <br />Application for Exempt Permit to PACE (Paper, <br />Allied- Industrial, Chemical & Energy Workers <br />International Union, Local #7 -0264 <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />PACE, Local #7 -0264 is planning a gun raffle in conjunction with its 9th Annual Golf <br />Tournament. The tournament is being held at Chomonix Golf Course on September 18, <br />2004. <br />All lawful gambling conducted in Minnesota requires authorization from the Minnesota <br />Gambling Control Board in the form of a license, exempt permit or excluded <br />authorization. An exempt permit may be issued to non -profit organizations conducting <br />lawful gambling activity on five or fewer days during a calendar year. PACE holds just <br />this one tournament every year. <br />Minnesota Statute, Chapter 349, Section 349.166, Subd. 2 does, however, require that the <br />non -profit organization applying for the exemption permit notify the City. The City must <br />than take action at least 45 days prior to the event. Because the event is to take place less <br />than 45 days after council approval, the applicant requests that the council approve the <br />application with no waiting period, an option on page two of the exempt application. A <br />copy of the application for the exempt permit is complete and on file in the city clerk's <br />office along with the forms showing tax exempt status. <br />Attached are flyers with information regarding the golf tournament and the gun raffle as <br />well as the contract agreement between PACE and Chomonix Golf Course. <br />OPTIONS: <br />1.
