• NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby <br />approves the application for a conditional use permit/planned unit development and <br />development stage plan. <br />• <br />BE IT FURTHER RESOLVED that the following conditions of approval apply: <br />1. Additional right of way shall be dedicated to Anoka County to total 60 feet from <br />centerline for Lake Drive (CSAH 23). <br />2. Right of access shall be dedicated to Anoka County along CSAH 23 on the fmal plat. <br />3. The fmal plat must include larger individual unit lots to ensure that the eaves and any <br />building projection meets the property line separation to meet fire protection <br />requirements in the building code. <br />4. The City Engineer's comments in the July 9, August 6, and September 2, 2004 <br />memos must be met to his satisfaction. <br />5. Park dedication shall be $28,170. A park dedication amount of $28,170 shall <br />be deposited in escrow by the developer prior to approval of the final plat by the city <br />council. The final park dedication amount shall be determined by a neutral arbitrator. <br />6. Existing buildings on the site shall be removed. <br />7. The existing well and onsite septic system shall be properly abandoned. <br />8. Stone or brick veneer base shall be included on all four sides of the buildings. <br />9. The project shall not be fmal platted until 2005 to comply with the growth <br />management policy. <br />10. The revised design shall be submitted for review by the Rice Creek Watershed <br />District. A permit must be obtained from the Watershed District prior to final plat <br />approval by the City. <br />11. Building colors shall be reviewed by staff. <br />12. Homeowners association declaration/covenants must be submitted for City Attorney <br />review as required by the City's fmal plat requirements. <br />13. This approval is based on the following submittals: <br />• Existing Conditions, May 5, 2004, received August 20 <br />• Preliminary Plat, revised August 19, 2004, received August 20 <br />• Grading, Drainage and Erosion Control Plan, revised August 19, 2004, received <br />August 20 <br />Resolution 04 -126, page 2 <br />
