The hardship is not due to economic considerations alone if reasonable use for the <br />property exists under the terms of the ordinance. <br />Economic do not create._ the need_ for a - variance... - -- -The- issue -is -a <br />permit from the Minnesota Dept. of Natural Resources, which is not controlled by <br />the City. <br />9. Granting the variance requested will not confer on the applicant any special privilege <br />that would be denied by this ordinance to other lands, structures, or buildings in the <br />same district. <br />• There is no known situation that would involve a permit from a state agency with <br />a deadline to build a bridge to an island. <br />That the proposed actions will be in keeping with the spirit and intent of the <br />ordinance. <br />• • The project itself, once approved by the City Council, is deemed in keeping with <br />the spirit and intent of the ordinance. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino <br />Lakes hereby approves a variance to allow the construction of the bridge permitted by <br />Minnesota Department of Natural Resources permit number 2001 -6109 prior to the <br />approval of the final plat for Pheasant Hills Preserve 12th Addition. <br />Adopted by the Lino Lakes City Council this day of <br />2004. <br />ATTEST: <br />• <br />hi;"o <br />, <br />J.
