• <br />City Council <br />Otter Lake Road ROW transfer <br />October 12, 2004 <br />CITY OF LINO LAKES <br />RESOLUTION NO. 04 -150 <br />AUTHORIZING TRANSFER OF CITY STREET RIGHT -OF -WAY TO <br />ANOKA COUNTY (OTTER LAKE ROAD) AND ACCEPTING RIGHT -OF -WAY <br />FROM ANOKA COUNTY (OTTER LAKE SERVICE ROAD) <br />WHEREAS, the City of Lino Lakes and Anoka County entered into a Joint Powers <br />Agreement executed by the City on July 7, 1998; and <br />WHEREAS, the parties to the agreement mutually agreed that Otter Lake Road should <br />continue to be on the County System; and <br />WHEREAS, the parties to the agreement mutually agreed that after construction of the <br />realigned Otter Lake Road it will be mutually desirable to turn over the existing Otter <br />Lake Road between the realignment and Main Street to the City; and <br />• WHEREAS, Section IX.0 of the Joint Powers Agreement stipulates that the both the <br />County and City agree to pass the necessary resolutions to transfer the roadways and <br />re- establish the County designations on the routes <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes, <br />Anoka County, Minnesota authorizes the Mayor and City Clerk to execute the deed to <br />transfer the realigned Otter Lake Road right -of -way to Anoka County. <br />BE IT FURTHER RESOLVED that the City hereby accepts the transfer of right -of -way <br />for the former alignment of Otter Lake Road (Otter Lake Service Road) to the City of <br />Lino Lakes. <br />Adopted by the Lino Lakes City Council this 12th day of October 2004. <br />Ann Bia'r,JCity Clerk <br />• <br />John J.
