Studenski, City Engineer <br />COUNCIL MEETING DATE: October 25, 2004 <br />TOPIC: Resolution No. 04 -158, Adopting Assessments, Birch /Hodgson <br />Improvement Project. <br />VOTE REQUIRED: 3/5 Vote Required <br />BACKGROUND: <br />The Birch /Hodgson improvement Project is currently under construction and <br />nearing completion. This improvement provides a benefit to the adjacent <br />properties, more specifically the Spirit Hills and Millers Crossroads <br />Developments. Signed petition and waiver agreements have been signed and <br />received from the benefiting property owners. Per the signed petitions and <br />waivers, the property owners waive any and all procedural and substantive <br />objections to the installation of the City improvements and the special <br />assessments. The Birch /Hodgson Improvement Project is substantially complete <br />and therefore, City Staff is prepared to adopt the assessments. <br />The developer's have reviewed and approved the assessments. <br />OPTIONS: <br />1. Adopt Resolution No. 04 -158, Adopting Assessments for the Birch /Hodgson <br />improvement Project. <br />2. Not Adopt Resolution No. 04 -158. <br />3. Return to staff for further review. <br />RECOMMENDATION: <br />Staff recommends Option No. 1. <br />
