Studenski, City Engineer <br />COUNCIL MEETING DATE: October 25, 2004 <br />TOPIC: Resolution No. 04 -160, Adopting Assessments, Marshan Lane <br />Utility Improvements <br />VOTE REQUIRED: 3/5 Vote Required <br />BACKGROUND: <br />The Marshan Lane Utility Improvements were recently constructed to provide <br />sewer and water service to Marshan Lane and a new Subdivision named <br />Marshan Estates. In a development agreement dated July 26, 2004, the <br />property owners waive any and all procedural and substantive objections to the <br />installation of the City improvements and the special assessments. The <br />Marshan Lane Utility Improvements are substantially complete and therefore, <br />City Staff is prepared to adopt the assessments. <br />The developer has reviewed and approved the assessments. <br />OPTIONS: <br />1. Adopt Resolution No. 04 -160, Adopting Assessments for Marshan Lane <br />Utility Improvements. <br />2. Not Adopt Resolution No. 04 -160. <br />3. Return to staff for further review. <br />RECOMMENDATION: <br />Staff recommends Option No. 1. <br />
