CITY OF LINO LAKES <br />RESOLUTION NO. 04 -181 <br />RESOLUTION AUTHORIZING ACQUISITION OF RIGHT -OF- WAY /EASEMENTS — <br />HOLLY DRIVE IMPROVEMENTS PROJECT. <br />WHEREAS, pursuant to resolutions of the Council adopted October 28, 2002, a study <br />has been prepared by the City Engineer, with reference to the improvement of Holly <br />Drive by constructing Street, storm sewer, and watermain extensions, and <br />WHEREAS, pursuant to resolutions of the Council adopted January 12, 2004, <br />authorizing the preparation of plans and specifications for the Reconstruction of Holly <br />Drive and <br />WHEREAS, pursuant to the resolutions of the Council adopted July 26, 2004, awarding <br />the construction contract for the Reconstruction of Holly Drive to W.B. Miller Inc., and <br />WHEREAS, the improvement consisting of construction of storm sewer and street <br />improvements is herein determined necessary to provide for safety of the public, and <br />WHEREAS, permanent easements and fee simple interests over certain lands are <br />required to provide for said construction, and <br />WHEREAS, Lino Lakes has authority to acquire right -of -way for said improvements <br />pursuant to Minnesota Statutes. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Authorizes the payment of acquisition of right -of- way /easements as detailed in the <br />appraisal dated December 3, 2004. <br />Adopted by the Lino Lakes City Council this 13th day of December, 2004. <br />Ann Blair, /pity Clerk <br />Jo J.
