COUNCIL MEETING MARCH 13, 1989 <br />Mr. Stahlberg explained that the City is giving this <br />responsibility to the contractor through the construction <br />contract. <br />Mr. Rasumssen referred to the counter proposal presented by <br />the landowners. He,told the Council that they were lucky <br />that they were not asking for damages due to stress. He said <br />that the Council did not tell the landowners everything from <br />the beginning of the project. <br />Mr. Hawkins said that there should be additional negotiation. <br />He noted that by following the eminent domain procedure, the <br />City will be paying each landowner up to $500.00 to hire <br />their own land appraiser. Mr. Hawkins said he would be <br />willing to give the $500.00 to the landowner as part of the <br />negotiations. <br />Mr. Bisel asked Mr. Hawkins to explain the procedure for <br />starting the eminent domain procedure. It was noted that Mr. <br />Hawkins would be negotiating for the City. Mayor Benson <br />asked assuming the Council decides to do as Mr. Hawkins <br />recommends, can the Council still negotiate with the <br />landowners. Mr. Hawkins said yes and the Council could <br />authorize anyone they wish to be a part of the negotiations <br />procedure. <br />Mr. Neal asked Mr. Rasmussen if he and the other landowners <br />have come to an agreement as to what they wanted. Mr. <br />Rasmussen said no, but definitely more than what the City was <br />offering. <br />Mr. Rasmussen explained that reasonable people should be able <br />to get together and negotiate a settlement. He said he would <br />like to see this and noted that the landowners are asking for <br />$9,500.00 without the purchase of the easement. Mr. <br />Rasmussen said he wanted $10,000.00, no SAC or WAC charges <br />and a well drilled on his property. Mayor Benson said he <br />felt that this would have to be negotiated. A lady in the <br />audience said they have been waiting since December, 1988 for <br />someone to start the negotiation process. <br />Mr. Hawkins reminded the Council that there is still the <br />matter of easements along the entire length of the <br />improvement. He recommended that all landowners be included <br />in the action and they can back out as they negotiate <br />settlements with the City. <br />Mr. Rasmussen said that no one on Rustic Lane wants to hold <br />up the improvement. <br />Mr. Neal moved to have Mr. Bisel and Mr.Bohjanen negotiate <br />along with Mr. Hawkins. Mr. Bisel seconded the motion. <br />There was further discussion regarding starting the eminent <br />_domain process while the negotiation process was in progress. <br />Mr. Rasmussen said he had hoped that the Council would not go <br />
