, COUNCIL MEETING June 26, 1989 <br />I they residential street. Mr. Wahlberg asked why MSA monies have to be <br />sed on 2nd Avenue. Mr. Stahlberg explained that it is the only street <br />n the area that would service the new subdivisions that qualify for <br />he funding. Mr. Stahlberg explained the criteria and that this street <br />was placed on the MSA list for Lino Lakes long before the development <br />started in this area. <br />Voting on the motion, motion carried unanimously. <br />Resolution No. 44 - 89 Agreeing to Conditions of Grant for 80th Street <br />Bridge - Mr. Bisel moved to approve this resolution. Mr. Reinert <br />seconded the motion. Motion carried unanimously. Mr. Schumacher <br />updated the Council on this improvement noting that it is under <br />construction at this time. <br />Rohavic Oaks, 2nd Addition - Mr. Stahlberg explained that he has <br />contacted the David Aras' regarding obtaining right -of -way for the <br />north /south street connecting Woodridge Drive with White Oak Drive. He <br />reminded the Council that this route was changed to accommodate the <br />Aras' in the event that they would wish to develop their property in <br />the future. He asked for permission to proceed with the negotiations <br />and asked for approval to proceed with condemnation procedures if <br />negotiations fail. Mr. Aras was in the audience and asked why Mr. <br />Stahlberg was requesting an additional 100 foot right -of -way. After <br />further discussion with Mr. Aras, Mr. Bisel asked that Mr. Stahlberg <br />Iroceed with further negotiations and bring the matter back to the <br />ouncil at the next meeting. <br />Right -of -Way Status, Mary Ann McDougal - Mr. Stahlberg explained that <br />there is a drainage area on the south side of Woodridge Estates. There <br />has been a problem with locating the ditch as was originally agreed <br />during the improvement hearing. The ditch will probably be moved <br />between lot No. 6 and lot No. 7. <br />ATTORNEY'S REPORT - BILL HAWKINS <br />Rehbein's Peltier View Access to Peltier Lake - Mr. Hawkins explained <br />that this matter had been brought to the Council's attention at the <br />last Council meeting. He has checked the ownership of the lot south of <br />the DeGeer lot on Peltier Lake and it does belong to Willard Rehbein. <br />He noted that the Peltier View Association has not yet been <br />established. The intent is to make some changes such as restrictive <br />covenants and then file it. <br />Mr. DeGeer said he has called Anoka County and they tell him the actual <br />owner is Gordon Rehbein. Mr. DeGeer asked how a Realtor could sell <br />land that did not belong to him. <br />Mr. Tom Hovey from the Department of Natural Resources was in the <br />udience and addressed the use of the lot in question. He said that <br />he DNR would not approve the use of the lot as it was outlined to him. <br />r. DeGeer told the Council that he has contacted Dale Barber at the <br />St. Paul Water Department and was told that there could be no docks <br />
