1 <br />1 <br />COUNCIL MEETING DECEMBER 26, 1989 <br />would require power companies to locate transmission lines <br />where they will do the least harm. <br />Acting Mayor Reinert asked if the City would be <br />discriminating by enacting this ordinance. Mr. Hawkins said <br />he had discussed this matter with Mr. Miller and felt that as <br />long as the City had legitimate reasons for the locations of <br />the poles, there would be no discrimination. Mr. Bisel said <br />he had a problem with allowing transmission poles in one <br />district but not allowing them in another district and <br />wondered if this was discrimination. Mr. Miller explained <br />that this ordinance would prohibit these types of <br />transmission lines in executive zones because they would <br />interfere with the amenities normally found in executive <br />areas. <br />Acting Mayor Reinert asked if it were possible to review all <br />installations of power poles within the City. Mr. Hawkins <br />said the City could require that a Conditional Use Permit be <br />obtained for all such installations and then the Council <br />could review each installation. He also noted that standards <br />would have to be written for each zone in the City and then <br />the Conditional Use Permits would be issued or denied based <br />on these standards. <br />After further discussion, Mr. Miller was asked to revised his <br />ordinance to require a Conditional Use Permit for <br />transmission lines over 69KV. The Council generally agreed <br />with the height restriction. <br />Mr. Neal asked if there would be a problem locating power <br />poles near a shopping center. It was explained that it was <br />likely these poles would not be near residential areas. <br />Mr. Bisel moved the first reading of Ordinance No. 12 - 89 <br />with the following stipulations; Section No. I, paragraph No. <br />2 be deleted and be replaced by "the erection of utility <br />poles for 69 KV or more shall be by Conditional Use Permit" <br />and this change be sent to the Planning and Zoning Board for <br />their review. Mr. Neal seconded the motion. Mr. Bisel asked <br />Mr. Schneider and Mr. Boxrud if they could see any problem <br />with this change. They could not see a problem. Motion <br />carried unanimously. <br />CONTINUATION OF PUBLIC HEARING ON 1990 BUDGET AND AUTHORIZING <br />RESOLUTION NO. 77 — 89 ADOPTING THE BUDGET AND RESOLUTION NO. <br />88 — 89 CERTIFYING THE 1989 TAX LEVY, COLLECTABLE IN 1990 <br />Acting Mayor Reinert opened the public hearing at 7:42 P.M. <br />Mr. Schumacher explained that the Council will be dealing <br />with two issues at this public hearing; adopting the 1990 <br />General Fund Operating Budget and adopting the 1989 Tax Levy. <br />He explained the procedure required by the legislature and <br />noted that all publications have been completed as required. <br />PAGE 3 <br />
