1 <br />1 <br />1 <br />COUNCIL MEETING AUGUST 13, 1990 <br />culvert in the lake channel. This is a major issue with the <br />area residents since the channel is twenty six (26) feet wide <br />and the culvert is only eight (8) feet wide. Placement of <br />the culvert would reduce the channel by sixteen (16) feet. <br />Mr. Miller also noted a legal problem regarding the use of <br />Outlot B as access since Outlot B is now being used for other <br />purposes. He asked how many times can you use one parcel. <br />Mr. Miller said he has met with most of the residents to <br />resolve their questions and concerns. The matter has not <br />been resolved. <br />Council Member Reinert moved to approve the recommendation of <br />the City Engineer or Option No. 1 on the "green sheet ". <br />Council Member Bohjanen seconded the motion. <br />Frank Kern, 2019 Otter Lake Drive, President of the Otter <br />Lake Assn. asked the Council to hear the concerns of the <br />residents before they make a decision regarding the EIS. He <br />noted that the residents were requesting a full EIS. Mayor <br />Bisel explained that there will be other opportunities for <br />the residents to express their concerns and noted that the <br />finding by the various agencies do not indicate a need for an <br />EIS. Mr. Kern felt the Council had not been to the site and <br />was not aware of the issues involved. <br />Mayor Bisel explained that this is not a public hearing, <br />however if the motion is approved all residents will have a <br />change to express their concerns. <br />Mr. Kern explained that the question from the Historical <br />Society should require an EIS. He said the law is being <br />violated regarding length of cul -de -sacs and noted that State <br />Statutes say no public waters can be obstructed. Mr. Kern" <br />told the Council that if they want to do the right thing they <br />will vote to have an EIS completed by the developer. <br />John Elliot, 6326 Otter Lake Road suggested that the ancil <br />set a public hearing before the vote on the above mc: n. <br />Mayor Bisel explained this could not be done. <br />Council Member Reinert suggested a neighborhood type <br />meeting with the residents and withdrew his motion. anvil <br />Member Bohjanen withdrew his second. <br />Mr. Adamson, developer of Oak Brook Peninsula told <br />Council that he is going through all the agencies t. the <br />proper permits. He noted that this is not an envir t <br />issue and also noted that the property on the west t of <br />the channel is for sale. Mr. Adamson said all EAW x s <br />will be satisfied and also noted that the channel w, <br />illegally dug.
