1 <br />1 <br />COUNCIL MEETING OCTOBER 8, 1990 <br />Mr. Hawkins was absent and there was no report. <br />CONSIDERATION OF IMPROVEMENTS FOR MR. MORT HUBER, ACORN <br />DEVELOPMENT, RANDY SCHUMACHER <br />Mr. Schumacher explained that Mr. Huber attended the <br />September 24, 1990 Council meeting and expressed major <br />concern regarding whether or not he would be allowed to <br />install his own improvements and use his own engineer's on <br />the Birchwood plat improvements. The Staff was asked to <br />research the circumstances surrounding Birchwood and the <br />installation of the Chomonix Trunk. <br />Mr. Schumacher noted that Mr. Huber began his development <br />during a period of time when the Council was rethinking their <br />policy regarding developer installed improvements. Mr. Huber <br />was led to believe that his engineers would be allowed to <br />design the improvements. With this in mind, Mr. Schumacher <br />proposed the following option and recommended its adoption: <br />1. Allow Mr. Huber to install his own improvements with the <br />following provisions: <br />A. The City Engineers review the design, plans and <br />specifications and all plans, designs and <br />specifications would be subject to the City <br />Engineers approval. <br />B. The City Engineers observe and coordinate during <br />construction. <br />C. The City Engineers communicate with the MWCC and <br />Metro Council. <br />D. The developer petition for trunk services. (Mr. <br />Huber will not be allowed to use a temporary <br />connection to the Shenandoah Trunk. The Chomonix <br />Trunk will not be available until late October, <br />1991 <br />Mr. Schumacher explained that Mr. Huber has agreed to all of <br />the above provisions. <br />Council Member Kuether reminded the Council that there was <br />discussion regarding amending the Developer's Guide to <br />reflect the change in City policy. Mr. Schumacher said that <br />this was already being done. <br />Council Member Reinert moved to approve the recommendation of <br />the City Administrator to include Sections A, B, C and D. <br />Council Member Bohjanen seconded the motion. On a roll call <br />vote, motion carried unanimously. <br />Council Member Reinert moved to direct the City Administrator <br />to put in place an amendment to the Developer's Agreement <br />which would no longer allow developer installed improvements <br />unless the Council give authorization prior to preliminary <br />plat approval.
