1 <br />2 3 J <br />COUNCIL MEETING FEBRUARY 27, 1989 <br />FIRST READING, ORDINANCE NO. 03 - 89, CHARTER AMENDMENTS <br />Mayor Benson explained that the Charter Commission has net <br />several times and has prepared and recommended that the <br />Charter be changed to reflect the langauge in Ordinance No. <br />03 - 89. He noted that the vote for the ordinance was not a <br />unanimous vote <br />Mr. Jerry Hanson, Chairman of the Charter Commission' asked to <br />present the minority view of the Charter Commission which is <br />opposed to the Charter change as presented. He explained <br />that the ordinance would take away the rights of the people <br />in Lino Lakes and is not in the best interest of Lino Lakes. <br />He noted that the minority members of the Commission were <br />working on a proposal with Mr. Kennedy an attorney with <br />Springsted, Inc. bond consultant for Lino Lakes. He <br />recommended that the Council return the ordinance to the <br />Charter Commission for futher review and change. <br />Mr. Eugene Lane told the Council that felt the Charter <br />Commission'had moved to rapidly and should take more time <br />to consider other proposals. <br />Mr. Bill Spears said he lives in Arena Acres and agreed with <br />Mr. Lane. <br />Mr. David Kennedy explained that he was asked to work with <br />the Charter Commission regarding this issue because he works <br />as the bond consultant to the City and did point out the <br />technical difficulties and langauge terms that make this <br />portion of the Charter difficult for him to work with. He <br />noted that the proposal put forth by the minority members of <br />the Commission was not his recommendation but he did prepare <br />the langauge process that they are using. He noted that the <br />langauge that they wish to include would allow residents to <br />file a petition and omit themselves for a particular <br />improvement. This could stop a project completely and cause <br />a great deal of "mischief" in getting a project completed. <br />Mr. Reinert asked if there was a compromise or has some one <br />not done a thorough job of explaining the short falls of the <br />current Charter. He felt this was a paramount issue in this <br />community and the Council owed it to the citizens to return <br />the ordinance to the Charter Commission for one last final <br />try for a compromise. <br />Mr. Bisel asked how many people know that we are a charter <br />city? He felt that the people think that if Chapter 8 is <br />replaced by state statute No. 429 they will no longer be <br />heard. He felt the statute No. 429 allows for a lot of <br />input. He noted that Mr. Kennedy is saying that Chapter 8 <br />can prohibit this City from selling bonds in the bond market <br />-and at soe point Mr. Kennedy will be asked to defend the <br />Charter and he will have a very difficult time doing so. <br />
