COUNCIL WORK SESSION <br />CITY OF LINO LAKES <br />COUNCIL MINUTES <br />SEPTEMBER 9, 1991 <br />DATE September 9, 1991 <br />TIME STARTED 6:00 P.M. <br />TIME ENDED • 6:24 P.M. <br />MEMBERS PRESENT: Bisel, Bohjanen, Kuether, Neal, Reinert <br />MEMBERS ABSENT : None <br />Staff members present: City Engineer's, Darrell Schneider and <br />Dan Boxrud; Fire Chief, Milo Bennett; Administrator, Randy <br />Schumacher and Clerk - Treasurer Marilyn Anderson. <br />DARLA LOWELL LETTER <br />Mr. Schumacher explained the background in this matter. Council <br />action on the matter was not satisfactory to Ms. Lowell. She <br />feels that she has been "wronged" by SEH and Dan Boxrud and has <br />written a letter to SEH demanding that her escrow be returned or <br />she will create problems for SEH. Mr. Schumacher noted that this <br />is a complex issue. Mr. Boxrud followed Council directives and <br />no staff member has done anything incorrectly on this matter. <br />Mr. Schumacher explained that he thought the Council was lenient <br />and worked with Ms. Lowell. There is no proof of any wrong <br />doing. <br />Mr. Boxrud explained that her letter is stating that because the <br />road did not go through and because she was not aware that she <br />must petition a second time, she should get her money back. She <br />feels that she paid for an approval and did not get an approval. <br />She did not realize that she paid for the process and there was <br />no guarantee that the Council would approve her request. She <br />feels there was never an intent to build the project which is not <br />true and she said she would make sure that SEH was not re- <br />appointed as consulting city engineer. <br />There was discussion regarding whether or not Ms. Lowell was made <br />aware of the procedures in this matter and warned that her <br />request may be denied. Mr. Schumacher explained that the staff <br />followed all procedures. Mr. Boxrud told the Council that SEH <br />will give back to the City fees charged to prepare estimates on <br />alternative street plans. The $3,000.00 escrow paid by Mrs. <br />Lowell for the original feasibility will not be returned to Ms. <br />PAGE 1 <br />1 <br />1 <br />1 <br />
