However, Mr. <br />Birch needs to engage in good faith discussions. <br />Council Member Reinert asked if the motion is defeated this <br />evening, can it be brought back at any time. Mr. Hawkins <br />explained that a four fifths vote is needed to pass. If the <br />motion is defeated, it can be brought back at any time. <br />VOTING ON THE MOTION: <br />Bisel <br />Bohjanen © Kuether <br />Neal ❑ Reinert ❑ <br />Abstained: Reinert. Council Member Neal was absent. <br />Motion failed because a four fifths vote is needed. <br />Consideration of Amelia Lake Estates Rezone, Ordinance No. 10 - <br />91, FIRST READING - Council Member Kuether moved to delay action <br />on this matter until after the meeting between the developer and <br />the residents. Council Member Bohjanen seconded the motion. <br />Mr. Knaack explained that if the Council votes to deny the rezone <br />and the reasons for the denial are found to be insufficient, the <br />matter can be brought back before the Council at any time. Mr. <br />Hawkins, City Attorney said this is correct, the staff should <br />prepare the reasons for denial of the rezone and then the Council <br />should vote on the matter. The petitioner has the right to have <br />specific reasons for denial of the request. <br />Council Member Kuether withdrew her motion and Council Member <br />Bohjanen withdrew his second. <br />Council Member Reinert left the Council chambers for a few <br />minutes. When he returned Council Member Bohjanen moved to <br />approve Ordinance No. 10 - 91. Mayor Bisel seconded the motion. <br />Council Member Kuether said that the services must be approved <br />before the rezoning can be approved. She felt the rezoning <br />matter should be considered after the meetings between the <br />developer and the neighbors. If the meetings fail, the Council <br />will have to take action to resolve the matter. <br />VOTING ON THE MOTION: <br />Bisel <br />Bohjanen © Kuether <br />Neal ❑ Reinert ❑ <br />Abstained: Reinert, Council Member Neal was absent. <br />Motion failed.
