Q-7_. , -4 ,�., -.� <br />Clerk- Treasurer <br />July 29, 1974 <br />The special meeting of the Lino Lakes City Council was called to order at <br />8:05 p.m. on July 29, 1974 by Mayor Bohjanen. Councilmen present; Jaworski, <br />McLean, Zelinka. Absent; Marier. Mr. Locher and Mr. Springstead were also present. <br />Mayor Bohjanen said this meeting had been called for the purpose of discussing <br />the status of the Temporary Bonds that are due on November 1, 1974. He turned <br />the meeting over to Mr. Springstead for his comments. <br />Mr. Springstead said that he would require some information in order to assess <br />the situation. He asked what assessments are due and when they are expected. <br />He also asked what the total assessment was. <br />The Clerk will compute these figures for Mr. Springstead. <br />Mr. Locher reported on the condemnation procedures that had been received for <br />the Anoka County Park for Mr. Parta's office. The parcels are listed by number <br />but do not give the legal descriptions. These descriptions are necessary in <br />order to compute the assessments due on these parcels of land. Mr. Locher said <br />that he did not know if the residents who are challenging the condemnation of <br />the land planned to appeal the District Court decision or not. The owners of the <br />land may petition for 75% of the amount awarded. He said the City could decide <br />on how much of the specials should be paid at that time, but he would strongly <br />recommend that the entire amount due be paid at the time the monies are awarded. <br />Since the legal descriptions are not listed on the condemnation awards, the <br />Clerk will have to determine what parcels of lands are included in each of the <br />awards and compute the special assessments due. <br />Mr. Springstead will make a list of the information he needs. The Clerk will <br />have to get the plat and parcel numbers from the Anoka County Park Department. <br />On the condemnation procedures that had been challenged by a group of residents <br />of Lino Lakes and Centerville, Judge Larson upheld that the law giving Anoka <br />County the right of condemnation was a valid law. Mr. Brooke, Attorney for the <br />residents, had contacted Mr. Locher with the suggestion that Lino Lakes enter <br />into the appeal with these residents. Mr. Locher estimated the cost to the City <br />of a minimum of 2 to 3 thousand dollars. <br />There was discussion on this possibility. The general consensus of the Council <br />was this would be going back on the agreement that the City has with Anoka County. <br />Also, at the present time the City is not a land owner as such. <br />
