September 9, 1974 <br />Mr. Tichner said that since Midway Ford was open this evening he could pos- <br />sibly contact a mechanic and get some sort of an answer on the installation of <br />the 4 bbl. carburetor. He left to use the phone. He will also check on the <br />cost. <br />Mayor Morstad, Benjie Munson and Fire Chief Goertz of Lexington were here to <br />discuss the 1975 Fire Contract. Mayor Morstad asked Mr. Munson to present the <br />contract to the Council. <br />Mr. Munson reported that the charges will be computed in the same manner as <br />last year and the only change in the rates would reflect the increase in <br />valuation. He discussed the wong/ the% the Centerville contract that allows <br />Centerville to collect $100.00 per hour from the home owner, Lexington would <br />like to include this wording in their;oontract. <br />Chief Goertz said that Is any one has any complaints on the service of the <br />Fire Department, he asked that these be forwarded to him. <br />Mr. Clem Frazer asked about the charges to persons who do not have this fire <br />service clause written into their insurance policy. Would all people be inform- <br />ed of this charge and would they have to take out this insurance? <br />Mr. Jaworski said, No, the woxc]}ding is such that this only applies to person <br />who now have such insurance. <br />Mayor Bohjanen thanked the representative for Lexington and told them that <br />the Council will consider this at budget meetings that will begin this week. <br />Mr. Prokop and Mr. Jankus had presented the Council with a petition for the <br />installation of Lakeview Avenue; in the Otter Lake Hills Plat. The Clerk read <br />the petition which asks for a variance to Ordinance 22, Sections 20, 22 and 23. <br />They request that an oiled roadway of 32 foot width be installed at this time <br />since this will serve two families and should be sufficient for the amount of <br />traffic generated by these two homes. They request that no other building be <br />allowed until such time as the street is brought up to City specifications. <br />Mr. Locher read the Ordinance pertainingoto the variance request. He would <br />recommend that if this request is granted, that building permits for Mr.Prokop <br />and Mr. Jankus, (1 each) be issued and no other building permits be issued until <br />the street is brought up to specs. <br />Mr. McLean asked if this would be setting a precedent? Mr. Locher said that any <br />time a variance is granted there is this danger. He said that if this is grant- <br />ed it should be carefully documented. <br />Mr. McLean asked if the other property owners can legally be stopped from build- <br />ing on their property? Mr. Locher said that he had not completely researched <br />this, but he had found cases from New York where the municipalities did refuse <br />to issue building permits until the street was brought up to City specifications. <br />1 <br />I <br />
