City Council <br />May 27, 2003 <br />Laumeyer Variance <br />CONCLUSION <br />The City of Lino Lakes has adopted the Shoreland Management Overlay Ordinance as <br />required under Minnesota State Statute. The applicant's property is subject to the <br />ordinance, being within 1,000 of the OHWL of Lake Amelia, a natural environment lake. <br />The Shoreland Ordinance requires that any additions constructed within such an area be <br />setback 150' from the OHWL, with a septic system that is fully compliant. <br />In this case, the narrowness of the lot precludes siting a structure in such a way that it <br />would meet the required 150' setback from the OHWL as well as the 40' setback from <br />Centerville Road, and so hardship is demonstrated. The City has no information as to the <br />compliance status of the existing septic system and, as a result, a certificate of <br />compliance should be required, with replacement/improvement of the system to be <br />required, if indicated. Thus, staff would recommend approval of the proposed variance, <br />with the condition that the septic system by proven compliant. <br />P & Z BOARD RECOMMENDATION <br />Staff had initially recommended against this variance at the May 14th meeting of the <br />Planning & Zoning Board. At that meeting the board voted 5 -0 to approve the proposed <br />Variance. Draft minutes of the meeting are attached. <br />OPTIONS <br />1. Approval of the proposed variance. <br />2. Denial of the proposed variance. <br />3. Return to staff with direction. <br />RECOMMENDATION <br />Option #1 <br />
