1 <br />1 <br />III Mr. McLean said htat this was brought up at the Planning and Zoning meeting <br />but felt the members were not aware of all that is involved here. <br />April 23, 1979 <br />231 <br />The Public Hearing for the vacation of the Cul -de -sac at the end of Deer <br />Pass Trail was called to order at 9:45 P.M. Mr. Locher read the notice of <br />legal publication. <br />Mr. MCLean gave some background information about Derr Pass Trail construc- <br />tion and the agreements of 1974 and later in 1976, when Mr. Mattson built <br />his home. <br />Mr. Gotwald stated that the base of Deer Pass Trail does meet City <br />specifications, however, the blacktop is only 2" thick not the required 4 "/ <br />Mr. Charles Prokup was in the audience and said he would be opposed to Mr. <br />Jandus extending Deer Pass Trail if it meant additional houses would be <br />built creating additional street use. He felt the street would deteriorate. <br />Mr. Zelinka felt maybe this is the time to bring Rolling Hills Drive and <br />Deer Pass Trail up to City specifications and asses the affected property. <br />Mr. Prokup said he would be opposed to this also. <br />Mayor Karth explained the minutes from 0974 and said it appears that <br />additional building permits cannot be issued on this street ultil it is <br />ypgraded to City specifications. <br />Mr. Locher noted that naother resident refused to participate in the up- <br />grading of Deer Pass Trail. <br />Mayor Karth said the problem is as he sees it is Mr. Prikup does not want <br />to see any more building permits issued on Deer Pass Trail until it and <br />Rolling Hills Drive is upgraded. He is concerned about the asthetics <br />and the fact that the scree will not take the incrased traffic. <br />Mr. Gotwald noted there are 24 miles of substandard street in Lino Lakes <br />and if Mr. Jankus is denied a subdivision you would really have to deny <br />every other subdivision on substandard street. If the street is upgraded <br />by assessment then Mr. LaBuda and all affected property will have to share <br />in the costs uless Mr. Jankus pays the entire cost. <br />Mr. Jankus said he is willing to pay the eintre cost of installing the <br />extension and the new cul -de -sac and if the City feels Deer Pass Trail <br />should be upgraded, he is willing to pay his fair assessments on it as well, <br />but so should everyone else. <br />Mayor Karth suggest setting a public hearing on upgrading Deer Pass Trail. <br />Mr. Zelinka wondered if the City should go through the espense of a public <br />hearing when it will probably fail? <br />Mr. Jankus said he felt he should not be denied a building permit becasue <br />the neighbors do not want any further development. <br />Mr. Prokup pointed out that Mr. Jankus is no longer the owner of record of <br />the land he is extending the street on to. Mr. Jankus explained Mr. Wayne <br />Ellison is now the owner, however, when the original request was made he <br />was the owner and is now seeing the request to a conclusion. Mr. Zelinka <br />said the new owner should be brought in on these proceedings. <br />Mr. McLean asked, what ever conclusion is made here, the present owner will <br />have to consent?
