01.2 <br />COUNCIL MINUTES MARCH 11, 1991 <br />ATTORNEY'S REPORT - BILL HAWKINS <br />Resolution No. 23 - 91 Authorizing the City Attorney to Proceed <br />with Eminent Domain on Lot 17, Block 2, Carole's Estates, Second <br />Addition - Mr. Hawkins explained a resolution will not be <br />necessary. A motion by the Council will be sufficient. The lot <br />mentioned is located next to the lots owned by the City. These <br />lots will be developed as the new fire hall site. The City is <br />currently negotiating a purchase price with the owner and the <br />owner has indicated that he would like the City to find another <br />location for his business. The intent is to keep negotiating in <br />good faith. However, the process for building the new fire hall <br />could be stalled if this lot is not available at the proper time. <br />Therefore, the request is to begin the eminent domain process <br />while negotiations continue. <br />Council Member Reinert moved to approve the eminent domain <br />process for Lot 17, Block 2, Carole's Estates, Second Addition. <br />Council Member Kuether seconded the motion. Motion carried <br />unanimously. <br />OLD BUSINESS <br />FIRST READING, Ordinance No. 01 - 91 Reducing the Membership of <br />the Park Board - Mayor Bisel noted that this matter has been <br />discussed previously and was brought before the Council on <br />February 11, 1991. No action was taken at that time. He asked <br />that this matter be finalized this evening. <br />Council Member Bohjanen moved to approve the first reading of <br />Ordinance No. 01 - 91 reducing the membership of the Park Board <br />to five members. Council Member Kuether seconded the motion. <br />Council Member Bohjanen said he felt that no board need be larger <br />than the membership of the City Council. Mayor Bisel explained <br />that the rationale for this action was explained to the Park <br />Board. Council Member Neal said he would like the membership to <br />remain at seven (7). He noted that may be difficult to get a <br />quorum at times. Council Member Neal said he would also like the <br />membership of the DRB to be brought back up to seven (7). <br />Council Member Reinert said he understood that the DRB has been <br />operating with four (4) members recently. He was concerned about <br />tie votes in this situation. Mayor Bisel_ said he felt that this <br />was a legitimate concern. However, the City does have more staff <br />support for both of these boards and he could not remember when <br />either board did not have a quorum. Council Member Kuether noted <br />that residents were very interested and dedicated to serving on <br />these boards and did not see that there would be a problem with <br />getting quorums.
