142
COUNCIL MEETING MAY 13, 1991
street (members of the homeowners association) can request that
the City assume responsibility of the street and make the street
a public street. Mr. Hawkins said the City has no obligation to
accept this street or any other street or easement. He also
noted that the homeowners probably will never request that the
street become a public street because private streets do appear
to be a good selling attraction.
Council Member Bohjanen moved to approve DRB application No.
90 -66 approving a variance for Oak Brook Peninsula to permit
construction of a section of Otter Lake Drive to be located less
than 50 feet from the ordinary high water mark. The six (6)
findings -of -fact to support the variance are:
1. The land known as Oak Brook Peninsula could not be put to a
reasonable use without construction of Otter lake Drive.
2. The site of the land is such that access from any
point of high land is not possible because of the
on wetlands. In addition placing the road closer
north boundary line would cause removal of mature
vegetation and provide less of a filter from road
to the cranberry bog. Less cut and fill activity
required with the proposed road location.
other
impact
to the
(climax)
run -off
will be
3. No reasonable use of the property other than low density
single - family development exists.
4. The landowner will be required to build to all City
standards and all improvements will meet City standards.
5. The extension and location of the street will permit the
construction of high value dwellings ($500,000 and up) and
will not devalue the neighborhood.
6. The development of the area will be consistent with the
City's comprehensive plan and will not include development
at lesser standards than outlined in the City Code.
Mayor Bisel seconded the motion.
VOTING ON THE MOTION:
Bisel
Neal gl
Absent: none
Bohjanen
Reinert
Kuether
Motion carried. It was noted that this action by the Council
only gives the developer permission to construct the street. The
PAGE 5
