30 . <br />COUNCIL MEETING JANUARY 13, 1992 <br />utilities for the remaining phases of Pheasant Hills Preserve. <br />He gave a brief background on this development and noted that the <br />improvements installed in the first phase had been publicly <br />installed. He also noted that the preliminary plat for this <br />development had been approved prior to the amendment to the <br />improvement policy. Mr. Schumacher asked if the Council agreed <br />that the developer has the right to come before the Council and <br />request the right to privately install utilities for each of the <br />next phases of Pheasant Hills Preserve? Mr. Volk said it was his <br />understanding that the Council gave the developer the option of <br />requesting developer installed utilities. <br />Mayor Reinert explained that the Council action on December 19, <br />1991 was confusing. However, it was the consensus that the <br />developer may come before the Council at the beginning of each <br />phase and request that he be allowed to privately install the <br />utilities. The Council will make a decision based upon a review <br />of the developers performance on the prior phases. It was not a <br />"blanket" approval. The developer will be allowed to privately <br />install utilities in the second phase if he so desires. <br />Clarification of Council Action Regarding Rezone Request for <br />Amelia Lake Estates - Mr. Hawkins noted that the motion to <br />rezone Amelia Lake Estates failed at the December 19, 1991 <br />Council meeting. He explained that the minutes should contain <br />the reasons for this action. He also noted that the request to <br />amend the Comprehensive Land Use Plan also failed. To solidify <br />the City's position, reasons for each of the failures to approve <br />the requests should be set out in the minutes. The basis for the <br />effective denial on the requests should be outlined especially <br />since the City is in litigation on the matter. Mr. Hawkins <br />requested that approval of the December 19, 1991 Council Minutes <br />be delayed to formulate basis of the Council actions. He has <br />discussed this with legal counsel on the litigation issue and <br />they concur and a meeting will be held this week regarding the <br />litigation. In addition the landowner has the right to know why <br />the Council took that particular action. <br />Approval of the December 19, 1991 Council Minutes will be placed <br />on the January 27, 1992 agenda. <br />NEW BUSINESS <br />Consideration and Approval of Renewal of Ladies Auxiliary VFW <br />Post 6583 Gambling License - The Ladies Auxiliary is applying to <br />the state for renewal of their gambling license. This <br />organization has complied with the Lino Lakes Gambling Ordinance <br />and has provided a detailed list of places receiving benefit from <br />the proceeds of the gambling receipts.
