172 <br />COUNCIL MEETING MARCH 23, 1992 <br />There was discussion regarding adopting an amendment to the City <br />Code that would expedite this process. Mayor Reinert suggested <br />that the City act on the request before the Council at this time <br />and then consider amending the City Code at another time. Mr. <br />Schneider also recommended that the Council consider entering <br />into an agreement with the developer regarding future extension <br />of utilities on Rice Lake Lane. He also noted that there would <br />be a $500.00 per lot park dedication due at the time the City <br />Clerk affixes the City Seal to the deeds for recording at the <br />Anoka County court house. <br />Council Member Kuether explained that Mr. Walberg's newly created <br />lots have already been sold and he was not advised about the <br />agreement for utilities along Rice Lake Lane. She suggested that <br />this request be approved but notify all of the residents on the <br />east side of Rice Lake Lane of the new policy. <br />Council Member Neal moved to approve the minor subdivision and <br />variance request for Warren Walberg and Kathy Macioch, Lot 6, <br />Block 1, Ulmer's Rice Lake Addition and to mail notices to all <br />landowners on the east side of Rice Lake Lane notifying them <br />regarding the agreement to connect to utilities when they are <br />available with the exception of Lot 6, Block 1, Ulmer's Rice Lake <br />Addition because of the existence of a signed purchase agreement. <br />Council Member Elliott seconded the motion. Motion carried with <br />Council Member Kuether abstaining. <br />Resolution No. 92 - 40 Ordering Preparation of Plans for Black <br />Duck Estates and Black Duck Estates, Second Addition - Mr. <br />Schneider explained that the preliminary plats for these <br />subdivisions were approved March 9, 1992. It is proposed that <br />the Council allow the construction of utilities and other <br />improvements in these two (2) subdivisions following a new <br />procedure. The following is an outline of the procedure: <br />1. The developer would deposit financial security with the <br />City. <br />2. The City Engineer would prepare plans and specifications for <br />streets and utilities. <br />3. The developer would retain a contractor to install the <br />streets and utilities, such contractor would be required to <br />meet City approval. <br />4. The City would inspect all construction work on the project. <br />A detailed outline of the proposed development contract has been <br />prepared by the City Staff, City Attorney and Engineering <br />Consultants. The developer would be required to pay all the <br />costs attributable to this development and the City would not be <br />required to sell bonds to finance the improvement.
