Therefore, it will be treated under the State <br />Shoreland requirements which are more restrictive than the Lino <br />Lakes Shoreland Ordinance. A concept plan was presented to the <br />Planning and Zoning Board. This board requested that the <br />developer present a plan showing the subsequent phases. The plan <br />submitted by the developer shows subsequent phases in a darker <br />color. A proposed commercial development is shown in the <br />southwest corner of the proposed development. <br />The area is designated in the 1990 Comprehensive Land Use Plan <br />for multiple family development. The proposal is consistent with <br />the 1990 Land Use Plan and the current zoning which is R -4 which <br />allows development for multiple family development up to 15 units <br />per acre. However, the Shoreland Overlay District significantly <br />reduces the site's density potential. <br />Mr. Brixius gave a background on this matter. The original <br />proposal did not meet the conditions of the Zoning Ordinance and <br />did not meet all City and State Shoreland Requirements. A second <br />proposal was submitted that complied with the State Shoreland <br />requirements but staff noted 18 different items that needed <br />attention before approval could be given including the dedication <br />of three (3) acres of park land and compliance with required <br />setbacks. The Planning and Zoning Board tabled action on this <br />request until a final drawing was submitted meeting all of the <br />requirements. <br />Mr. Brixius explained that the applicant responded to the <br />Planning and Zoning Board's recommendations and presented a third <br />drawing which is being addressed this evening. This proposal is <br />being treated as a site plan since it is a condominium ownership. <br />People will buy the units but will own the entire property in <br />common. A condominium is not a type of housing unit, it is a <br />legal form of real estate ownership. A townhome is a type of <br />housing with shared walls and exterior exits for all units. <br />Separate ownership for each townhouse unit is being proposed for <br />this development. <br />The ownership is consistent with the proposal. The first phase <br />complies with the Department of Natural Resources (DNR) density <br />standards. The applicant is proposing 139 units for the second <br />phase. The current regulations indicate that 136 units would be <br />the maximum. Land at the southwest corner of this area would <br />have to be added to get the additional three (3) units. The <br />building elevations are 32 feet and meet the setback <br />requirements, the buildings meet the 30 foot setback from a <br />public street. Parking stalls along the circular road could be <br />granted a variance up to five (5) feet provided that adequate <br />landscaping around the parking stalls be installed to break up <br />PAGE 13 <br />
