An association consisting of <br />the dwelling owners will determine who parks on common interest <br />portions of the property. Mayor Reinert noted that associations <br />vary in the way they enforce the regulations of the common <br />interest community. Some associations do not enforce their <br />regulations very well. Mr. Ballic explained the 515B Uniform <br />Common Ownership Interest Act provides all the tools to properly <br />enforce common interest regulations. Mr. Hawkins said that he <br />would review the final document and if there are some conditions <br />that the City Council feels are essential, he will see that they <br />are included in the document. <br />Mr. Corson noted that the units will be sold starting at <br />$95,000.00 to $165,000.00. <br />Council Member Bergeson noted that the proposal is to build 110 <br />units in the first phase and 29 units in the second phase. Of <br />the 110 units, how many units are two (2) car garages and how <br />many are one (1) car garages. Mr. Corson said 48 units of the <br />110 will be one (1) car garage units. <br />Council Member Kuether asked why the second phase of development <br />would require a conditional use permit. Mr. Brixius explained <br />that the application for the first phase was presented to staff <br />before the new Shoreland Ordinance was finalized. Therefore, the <br />development of the first phase will be treated under the State <br />Shoreland Ordinance guidelines. All new development will be <br />handled under the Lino Lakes new Shoreland Ordinance guidelines. <br />A conditional use permit and a public hearing would be required. <br />Also the applicant has indicated an interest in a commercial <br />development at the corner of Aqua Lane and Lake Drive. Any <br />pursuit of this development would require a rezone and a public <br />hearing. <br />Council Member Kuether noted that the developer has purchased the <br />Wenzel home and property and asked if there were plans to <br />purchase the old farm site. Mr. Hokanson, the developer, said he <br />did not know. <br />Mayor Reinert noted item #14 on page five (5) of Mr. Brixius's <br />report and asked where any outdoor activities would take place. <br />Mr. Brixius explained that the first site plan that was presented <br />to staff did not show the second phase and the three (3) acre <br />park. That site plan had additional open space that could have <br />provided additional private recreation facilities. However, the <br />current proposal is indicating additional park and a dock and no <br />private recreation facilities. <br />Mr. Brixius suggested that item No. 8 be added to the seven (7) <br />PAGE 19 <br />12 <br />
