COUNCIL MEETING AUGUST 28, 1995 <br />what "periphery" meant. Mr. Ahrens explained that it meant around the perimeter. Mr. <br />Lyden referred to the fence to be installed on the north side of the Walseth property, 1101 <br />Holly Drive. He used the overhead projector to show the location of the proposed fence. <br />Mr. Lyden referred to a meeting with the developer in which it was determined that the <br />Walseth property would be fenced however, other property owners were discouraged <br />from having the opportunity to receive a fence. Mr. Lyden asked the City Council to <br />direct staff to contact the other property owners to determine if they also want a fence. <br />Mayor Reinert explained that he has not seen the letter Mr. Lyden was referring to and <br />explained that the letter would have to be examined from an engineering standpoint. <br />Mayor Reinert said that the entire Council would have to review the matter, probably at a <br />work session, and then the Council would decide what action, if any, was necessary at a <br />regular Council meeting. <br />Ms. Wyland explained that Mr. Lyden is referring to fencing around the subdivision. The <br />subdivision will be completed in phases. The first phase will be on the north side of Holly <br />Drive. In discussions with the developer, it was determined that the fencing issue would <br />be addressed as it related to Phase I since no work is to be done on the south portion of <br />the subdivision. Since that portion of the subdivision will not be completed until about <br />1997, it was determined to not address that fencing issue until the developers agreement <br />was finalized. The developers agreement that has been completed is for the first phase <br />only. Staff has met with Ms. Walseth and the developer in regard to the fencing issue. <br />Mayor Reinert explained that since this is an open mike item, the City Council cannot take <br />any action other than referring the issue to the staff. <br />Mr. Lyden said that the Walseth property is not the only property adjoining the first phase <br />of this development. Ms. Wyland explained that Ms. Walseth is the only landowner who <br />indicated that they want fencing. Mr. Lyden said he wanted a letter written to the other <br />landowners adjoining the north portion of the subdivision stating that they too have a right <br />to a fence and let us know if you want one. Mayor Reinert asked Ms. Wyland to work <br />with the City Engineer on this matter. <br />Mr. Lyden asked when Hokanson would start the grading on the first phase of the <br />subdivision. It was determined that he started a couple of weeks ago. It was also noted <br />that the development agreement and the financial guarantees were in place prior to the <br />start of any grading for the subdivision. Mr. Lyden asked if the City had a copy of the <br />final grading plan. Ms. Wyland explained that the City has the preliminary grading plan <br />and the developer is only doing the preliminary grading at this time. Mr. Lyden asked if <br />the City had a development agreement. Ms. Wyland said yes, the City prepares the <br />development agreement and the developer is required to sign the agreement and provide <br />the financial guarantees before any work is done on the site. <br />Mr. Lyden said that Mayor Reinert has often said that the developers hold all the cards. <br />Mayor Reinert said that he has never said that but has said that developers are guests in <br />our City.
