• <br />• <br />• <br />AGENDA ITEM 7 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />MEETING DATE: Monday, February 26, 2001 <br />TOPIC: Rockey Goertz, 325 Birch Street (Apitz) Minor Subdivision <br />Resolution No. 2001 -31 <br />VOTE REQUIRED: Simple Majority <br />DESCRIPTION: <br />This case involves a request by Rockey Goertz and Larry Grubbs to subdivide a 39.67 <br />acre parcel of property located at the north/east corner of Hodgson Road and Birch Street. <br />This minor subdivision would create two parcels: <br />Parcel A <br />Parcel B <br />3.98 net acres /3.51 upland acres <br />Lot size: approximately 493 x 330 <br />35.69 net acres /26.85 upland acres <br />Mr. Grubbs would retain ownership of the 3.98 parcel for future commercial development <br />and Mr. Goertz would retain the 35.69 acre parcel for development similar to the <br />enclosed sketch plan for Spirit Hills. <br />The property is currently Zoned R -1 Single Family Residential and located within the <br />existing MUSA line. The property immediately south containing Apitz Garage and the <br />small corner house is Zoned GB, General Business. Utilities can be extended to serve the <br />property. The Draft Comprehensive Plan guides this area for a mix of commercial, low <br />density residential and medium density residential. The current Comprehensive Plan <br />guides the area for single family residential. <br />Mr. Grubbs also owns the adjoining Apitz Garage and is the potential owner of the <br />adjoining City /County owned property at the corner of Hodgson Road and Birch Street. <br />The City /County and Mr. Grubbs are currently working on an agreement that would <br />include right -of -way dedication along Hodgson Road and transfer of the remaining parcel <br />to Mr. Grubbs. The property owner has agreed to dedicate an additional 27' to 29' of <br />right -of -way on the east side of Hodgson Road in this location which is acceptable to the <br />County. <br />Only the minor subdivision is being reviewed at this time. The concept plan is for <br />illustrative purposes only. Mr. Goertz plans to submit a preliminary plat/PDO for April <br />review by the P & Z and Council. <br />
