• Council Member 0' Donnell introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />RESOLUTION NO. 2001-61 <br />A RESOLUTION CONCERNING THE REACTIVATION OF FORMAL <br />RENEWAL PROCEEDINGS UNDER THE FEDERAL CABLE <br />COMMUNICATIONS POLICY ACT OF 1984, AS AMENDED. <br />WHEREAS, The City of Lino Lakes, ( "City ") entered into a cable television franchise <br />agreement ( "Franchise Agreement") with Group W Cable of the North Central Suburbs, Inc. <br />(d/b /a Meredith Cable Company) dated August 22, 1983, to provide cable television service <br />within the territorial limits of the City ( "Franchise "); and <br />• <br />WHEREAS, as a result of several transfers of the Franchise, MediaOne North Central <br />Communications Corp., d/b /a AT &T Broadband ( "AT &T Broadband ") is the current holder and <br />owner of the Franchise; and <br />WHEREAS, the North Metro Telecommunications Commission (the "Commission ") <br />was organized pursuant to Minn. Stat. § 471.59, as amended, for the purpose of coordinating, <br />administering and enforcing the Franchise on behalf of the City and the other member cities; and <br />WHEREAS, Section 626(a)(1) of the Cable Communications Policy Act of 1984, as <br />amended (the "Cable Act"), 47 U.S.C. § 546(a)(1), provides that if a written renewal request is <br />submitted by the cable operator during the 6 -month period which begins with the 36th month <br />before franchise expiration and ends with the 30th month prior to franchise expiration, a <br />franchising authority shall, within six months of the request, commence proceedings to identify <br />• <br />
