AGENDA ITEM 1C <br />• STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: April 23, 2001 <br />TOPIC: Resolution 01 -62, Clearwater Creek Business Center <br />Disbursement <br />VOTE REQUIRED: 3/5 Vote Required <br />BACKGROUND: <br />On November 13, 2000, the City Council approved the Final plat for the <br />Clearwater Creek Business Center (CCBC). At that meeting, the City Council <br />also discussed and approved the development agreement for this project. The <br />development agreement included a negotiated settlement of the costs related to <br />easement acquisition in the area between the developer, T & G Properties, and <br />the City of Lino Lakes. <br />As noted on Exhibit D of the agreement, the developer is providing easements <br />outside of the plat to accommodate trunk sanitary sewer and water <br />improvements. The final easement descriptions have been prepared by the <br />developer's surveyor and reviewed by the City. The amount due for these <br />easements is $139,325. The documents transferring this easement to the City <br />will be reviewed and approved by the City Attorney before releasing the <br />payment. <br />OPTIONS: <br />1. Approve the Clearwater Creek Business Center Disbursement <br />2. Return to staff for further consideration. <br />RECOMMENDATION: <br />Staff recommends Option 1. <br />• <br />
