11/22/71 127 <br />called to order at 10 :05 P.M. The property concerned was Outlot K of Lakes <br />Add'n. No. 2, to be known as Chamonix South. Mr. Locher read the notices, <br />noting publication of the hearing notice on November 4th, posting on November 4th, <br />and mailing of notices on November 5th. He read the-names of those to whom the <br />notices were mailed, and stated that the affidavits were all in order and the <br />notices timely. <br />Mr. Cardinal stated that a discussion on the square footage of the various <br />residential units had ensued at the P&Z hearing, and the matter had been tabled, <br />until the ordinance was clarified. Mr. Locher stated that he had talked with <br />Mr. Van Housen on November 19th, and that Mr. Van Housen wanted•to see the unit <br />plans first. He had suggested not amending the ordinance, but allowing a <br />variance. Mr. Locher stated that "footage" means "living room ". Mr. Van <br />Housen had felt that changing the ordinance might allow unsubstantial buildings. <br />Otherwise, there was no problem with the plat. <br />Crystal Ahlman stated that she sew two problems with the plat, namely the road <br />size which our Village says must be 66 feet wide and the square footage of the <br />units. Mr. Cardinal stated that these roads would be private. Mr. Gotwald <br />stated that dedicated roads must be 60 feet wide; however, in trailer parks, <br />P. U.D.'s, etc. any safe width from 24 -30' is eooeptable since the roads are not <br />public. Mr. Gotwald noted oleo that the surface of dedicated roads is usually <br />30 feet, but there is a 60 foot easement. Crystal stated that she had checked <br />the blaoktopped roads in Chamonix and they were no 60 feet. Mr. Gotwald stated <br />that the only blaoktopped road near Chamonix is old 7th Avenue which was 24 feet <br />wide, and that such existing roads are only eurfaoed to their existing width. <br />He stated that Main Street had only 24 feet of surface. The roads in this plat <br />will not be dedicated. <br />Mr. L'Allier stated that the specific floor plans would be gotten to Mr. Van <br />Housen. The Clerk noted that U. S. Lakes had requested a variance to the zoning <br />code and made payment of $25.00. Don Waalen stated that he had obtained copies <br />of the zoning oode since the P&Z meeting and that he felt that the requirement <br />of 1150 square feet for a 2 bedroom townhouse unit was inconsistent when a R -1 <br />house has a minimum of 880 square feet. He wished to ask for a variance to the <br />townhouse zoning to allow units of 780-square feet and thus allow them to proceed <br />with the plans as presented at the last Council meeting. He also wished to <br />get building permits for 2 model homes. <br />Mrs. Gould wished to know how this discrepancy in the building node was allowed <br />to happen, considering the hearings on the code. She didn't feel that U. S. <br />Lakes should be allowed to•build differenty from-the zoning code. She also <br />felt that builders should be given the minimum size of lots and houses. There <br />was discussion. Mrs. Gould mentioned a previous meeting when someone had noted <br />that Jandrio was building oraokerboxes in other locations and asked if we had <br />looked into this. She stated that we should put teeth in the code and allow <br />no variation.- Mr. L'Allier noted that we had given 4 variances already this <br />evening and that it was not unreasonable to deviate. Also, that the reason <br />builders are required'to submit a preliminary plat is so that changes and <br />corrections can be made and variances granted if the Council is so inclined. <br />Crystal asked about the townhouses as to size and how many were built. Mr. <br />Dielentheis stated that they had put up none of these units yet, but similar <br />modeli were under construction in Eagen Township this week. He noted that the <br />units were larger in the townhouse models built in Lakes No. 1, that these had <br />been priced to market at $39- 51,000, ranged from 1400 -2200 square feet in size, had <br />many amenities, but did not sell. The units now proposed are being built <br />throughout the metro area, and the sizes are oompatable with the rest in the <br />Metro area. He stated that they couldn't market any units if they were not <br />oompatable with others. He mentioned several other townhouse developments <br />presently selling which had sires very close to these proposed. <br />
