1 <br />1 <br />Mr. Bohjanen wished to include having a legal survey of the Phase 1 area done in <br />the motion, and that Menkveld will defend any cases arising out of the restriction' <br />on children. Mr. Menkveld and Mr. Summers both stated that they would hold the <br />Village harmless in such cases. <br />Mr. Bohjanen also wished included in the motion that these conditions would apply <br />to the heirs and assign, thus binding the future'. <br />It was noted that if we were sued, we would be reimbursed by Menkveld'for court <br />defense costs; also that the rezoning included in the motion is only for Phase 1 <br />of the proposal. ' <br />It was noted, in answer to Mr. Summers' question, that the above conditions would be <br />stated on the special use permit. <br />There was considerable discussion on the adequacy of the street width to handle <br />emergency vehicles in the cul de sac if cars were parked on the street. Mr. Menkveld <br />stated that there would be jaca on street parking; also that the trailers could be <br />spread apart a little if so wished. <br />After a few comments, Mr. Rosengren seconded the motion. <br />Mr. L'Allier noted that the vote would be on the rezoning and special use permit for <br />Mr. Gilbert Menkveld, and would include the variances and other requirements-. Mrs. <br />Bohjanen asked what the age limit on the trailers would be. After some discussion, <br />it was decided to place the maximum age limit on trailers to be moved in at-7 to 10 <br />years. It was mentioned that it was impossible to move the trailers out when they reached <br />that age, however; also, that there was an accelerated tax write —off over the first <br />5 year period of a trailer, then the tax remained the same after that. <br />The vote on the motion was as follows: Mr. Jaworski, no; Mr. Rosengren, aye; <br />Mr. Bohjanen, aye; Mr. L'Allier, no. <br />Mr. Jaworski moved to deny the request by Mr. Gilbert Menkveld for rezoning and a <br />special use permit for a mobile home'park upon the recommendation of the Planning & <br />Zoning Commission, the Planner and the Engineer as well as on the recommendation of <br />Superintendent Hankerson of School District #12 and based on correspondence from the <br />school superintendent, lack of sewer and water, and pending proposed legislation <br />regulating the overall tax structure for mobile homes. <br />Mr. Summers asked Mr. Jaworski if he specifically stated the reason for denying the <br />court was for taxes; Or. Jaworski stated, "No, not specifically." <br />Mayor L'Allier seconded the motion. Vote: Mr. Jaworski, aye; Mr. Rosengren, no; <br />Mr. Bohjanen, no; Mr. L'Allier, yes. <br />Mr. L'Allier stated that on 2 motions, both in favor of and against the proposal, <br />a tie vote was received in both; it was in order to continue the hearing until such <br />time that the fifth member would be present. Mr. Bohjanen moved to continue the <br />hearing until we have a full Council, namely on August 10th. After discussing the <br />fact that Mr. Cardinal would have to leave the next meeting early also, Mr. Smith <br />was asked if it was all right to switch the two hearing times, namely: the Menkveld <br />hearing on the 10th at $:30 p.m. and the Smith —Ecoff hearing.at 9:30 p.m. This was <br />fine. The motion was seconded by Mr. Rosengren. Carried unanimously. <br />
