106 <br />COUNCIL MEETING APRIL 12, 1993 <br />have been prosecuted. Mrs. Walmsley read Section 204.01 Policy <br />and Section 204.02 Covered Officials and Employees from the Code <br />of Conduct in the City Code and asked Mayor Reinert if he agreed <br />that the Code of Conduct covers the positions of Chairman of the <br />Planning and Zoning Board and the Chairman of the Charter <br />Commission. Mayor Reinert said that he would not respond this <br />evening. Mrs. Walmsley read Section 204.03 Responsibilities of <br />Public Office of the City Code and asked Mayor Reinert if he <br />agreed that these individuals were above reproach. She also read <br />minutes from the March 10, 1993 Planning and Zoning Board meeting <br />regarding the action of the Board on this matter. Mrs. Walmsley <br />said that the Chairman of the Planning and Zoning Board attempted <br />to carry out the recommendation of the Board by allegedly trying <br />to demolish the boat launch. She asked in light of this action <br />do you believe that in the future the Planning and Zoning Board <br />Chairman will be able to observe in his official acts the highest <br />standards of morality and to discharge the duties of his office <br />regardless of personal considerations. Mrs. Walmsley said she <br />was unhappy with this situation and requested that Mayor Reinert <br />request the resignation of the public officials that were <br />involved in the March 28, 1993 incident. She added that the Home <br />Owner's Association does not plan any personal action against any <br />of the individuals. <br />Mayor Reinert explained that since this matter was not on the <br />agenda this evening, the City Council will not take any action <br />other than to take the matter under advisement and place the <br />matter on the next City Council agenda. <br />Mrs. Walmsley noted that at the April 7, 1993 Council Work <br />Session, Mr. Hawkins said he had turned the March 28, 1993 <br />incident over to the County Attorney so that he could decide <br />whether any of the individuals would be prosecuted. She asked <br />Mr. Hawkins when he would make the police report available to the <br />County Attorney. She noted that the County Attorney had received <br />Mr. Hawkins letter but not the police report. <br />Mayor Reinert again stated that all comments this evening would <br />be taken under advisement and would be addressed at the next work <br />session. He also explained that all City elected and appointed <br />officials take the Code of Conduct very seriously. <br />Peter Brown, 6897 Black Duck Drive explained that he has observed <br />the situation regarding Outlots A and B escalate. He felt that <br />the City government is in a position of leadership in this matter <br />and should "spearhead" negotiations. He asked the City Council <br />to be aware of the concern this issue is causing.
