1 <br />1 <br />1 <br />COUNCIL MEETING MAY 24, 1993 <br />Mayor Reinert noted that Barb Sikora from Congressman Rod Grams <br />office had indicated to him that she would like to appear under <br />Open Mike this evening. Since she is not in the audience at this <br />time, her comments will be taken when she does arrive. <br />Martha Walmsley, 6978 Black Duck Drive - Ms. Walmsley noted that <br />Ordinance No. 93 - 07 was adopted at the last City Council <br />meeting and amended a portion of the Zoning Ordinance relating to <br />lot provisions. She noted that this is another clear example of <br />how the City Council re -interprets its own processes to suit its <br />own interests. The Reshanau Park Estates Homeowner's Association <br />was told by the City that anything that was not specifically <br />addressed in an ordinance is by definition disallowed or <br />prohibited. Mrs. Walmsley quoted from a "green sheet" prepared <br />by Ms. Wyland for the May 10, 1993 City Council meeting regarding <br />Ordinance No. 93 - 07. "Staff has determined that the Zoning <br />Code does not specifically prohibit the construction of buildings <br />located on unimproved right-of-way (ROW). Construction of <br />buildings on unimproved ROW could prove to be a serious detriment <br />to the orderly development of the City. Therefore, Ordinance No. <br />93 - 07 is being proposed to replace an emergency ordinance <br />enacted in March by the City Council." Mrs. Walmsley said this <br />statement implies that without this ordinance change, an activity <br />that was not specifically addressed in an existing ordinance <br />would have been allowed otherwise why amend the ordinance. She <br />continued, if omissions from the ordinances are prohibited why <br />was Ordinance 93 - 07 adopted? If omissions are allowed as <br />Ordinance No. 93 - 07 would suggest, why was the Reshanau Lake <br />Estates Homeowner's Association told otherwise? Mrs. Walmsley is <br />requesting that the City Council make an unambiguous statement <br />telling this community whether or not omissions from the <br />ordinances are allowed or prohibited. <br />LINO LAKES POLICE DEPARTMENT REPORT <br />Consideration of a Speed Monitor Proposal from the Lino Lakes <br />Police Department - Officer Keller explained that recently he <br />brought to the City Council's attention the possibility of <br />developing a traffic and weight enforcement unit for this City to <br />specifically deal with traffic problems within the City. The <br />purpose of the program is to actively enforce traffic related <br />laws for the safety of the community and those who travel through <br />it. Another purpose of the program is to ensure that all <br />relevant road weight restrictions are complied with on a seasonal <br />basis, preserving City owned and maintained streets. <br />Officer Keller asked that a three (3) month trial period be <br />implemented and the program be evaluated after that time.
