COUNCIL MEETING AUGUST 9, 1993 <br />explained that the surface water management plan will address <br />these problems and describe how to deal with them. When the plan <br />is completed, the staff will be able to address these problems. <br />Mr. Tufts noted the recent newspaper articles regarding the <br />Vadnais Heights holding ponds. It appears that the pond levels <br />have raised and now basements are being flooded. It was noted <br />that the City Engineer is now evaluating the problem. Council <br />Member Kuether noted that only a portion of the lots in Country <br />Lakes Estates will be in the flood plain area. The portion of <br />the lot in the flood plain cannot be built on. <br />Joyce Tufts, 6540 West Shadow Lake Drive referred to the proposed <br />street South Shadow Lake Drive and noted that it is planned to be <br />extended to the west through her property.. This upset her <br />because no one has talked to her about the future extension. Mr. <br />Schneider explained that in all new subdivisions, provision has <br />to be made for future development. It also makes good planning <br />sense to prepare for the future so that when you decide to <br />subdivide your property there will be access to a City street. <br />This plan also provides utilities for the Tufts property at no <br />obligation to them. Mr. Schneider said that there is no plan to <br />extend the street to the west. The street and utilities are <br />located for future planning only. <br />Council Member Elliott moved to close the public hearing at 8:16 <br />P.M. Council Member Neal seconded the motion. Motion carried <br />unanimously. <br />Mayor Reinert noted that the City Council cannot order the <br />improvement this evening. A 60 day waiting period begins this <br />evening to allow the persons who are to be assessed to reconsider <br />whether they wish to go forward with the improvement. The <br />developer who is the only person to be assessed can petition that <br />50 of the 60 day waiting period be waived. Also during this <br />time, staff will research the questions raised during the public <br />hearing. <br />Council Member Kuether moved to approve Resolution No. 46 - 93 <br />Ordering Plans and Specifications for Country Lakes Estates. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously. <br />Resolution No. 46 - 93 can be found at the end of these minutes. <br />OLD BUSINESS <br />Public Works Department Report - Council Member Kuether noted <br />that the new dump trunk is ready to be delivered to the City. <br />PAGE 11 <br />
