1 <br />1 <br />1 <br />COUNCIL MEETING OCTOBER 11, 1993 <br />REGULAR AGENDA <br />OPEN MIRE <br />No one appeared under open mike. <br />PLANNING AND ZONING BOARD REPORT <br />SECOND READING, Ordinance No. 93 - 15 Making Provisions for the <br />Opportunity as Well as the Control of Adult Use Activities and <br />SECOND READING, Ordinance No. 93 - 16 Regulating Adult Use <br />Activities - These ordinances were presented and discussed at the <br />September 27, 1993 City Council meeting. The ordinances identify <br />and define what adult activities are and sets out to regulate <br />accessory uses and where these uses can be located in the City of <br />Lino Lakes. Since this type of activity is protected by law, the <br />purpose of the ordinances is to prepare legislation that will <br />control the secondary impact of the uses. <br />Council Member Kuether asked if Ordinance No. 93 - 15 is <br />patterned after any particular ordinance in another city. Mr. <br />Brixius explained that the ordinance is tailored for Lino Lakes <br />and many different ordinances were used as models. He noted that <br />the separation area (opportunity area) of 300 feet is unique to <br />Lino Lakes. <br />Council Member Kuether asked if this ordinance should be reviewed <br />on an annual basis to be sure that it complies with all newly <br />enacted state and federal regulations. Mr. Brixius said yes <br />because Lino Lakes is a "young" community and is changing <br />rapidly. <br />Council Member Neal asked if Ordinance No. 93 - 16 should set a <br />limit on the number of hours any particular establishment can be <br />open. Mr. Brixius asked the City Council to delay action on this <br />ordinance for a few moments while he researched this question. <br />Council Member Kuether moved to adopt the second reading of <br />Ordinance No. 93 - 15. Council Member Neal seconded the motion. <br />Motion carried unanimously. <br />Ordinance No. 93 - 15 can be found at the end of these minutes. <br />SECOND READING, Ordinance No. 93 - 17 Amending Appendix B1, <br />Accessory Buildings and Structures - The first reading of this <br />ordinance was held at the September 27, 1993 City Council <br />meeting. The City Council suggested that subdivision (5) be <br />amended to include a provision that accessory buildings shall be <br />placed so as to not interfere with the future subdivision of the <br />PAGE 2 <br />.181 <br />
