A cash donation of 10% per acre of the current market <br />value be required as approved by the Park Board on <br />October 4, 1993. In addition, a trail shall be <br />dedicated on the existing farm road through Lots 1 and <br />2. <br />7. A development agreement shall be signed and financial <br />guarantees posted prior to any construction. <br />Mayor Reinert noted that with the establishment of easements over <br />the wetlands, the new property owner is made aware that there are <br />wetlands and they cannot be used. Ms. Wyland explained that the <br />easements will not extend beyond the platted area. <br />Council Member Bergeson asked if the extension of municipal sewer <br />to this subdivision would also supply service to the land west of <br />the proposed plat. Ms. Wyland said no, service for these <br />properties would be supplied from another direction. <br />Council Member Bergeson moved to approve the preliminary plat of <br />Oaks of Lino Lakes with the conditions as outlined above. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously. <br />Consideration of Variance, Sandhill Drive - A request for a <br />variance from the Larson's to construct a single family home on a <br />lot 23 feet from the front property line has been received and <br />reviewed by the Planning and Zoning Board. The lot is located in <br />Rice Lake Estates and is zoned Single Family Residential, <br />Executive (R -1X) with a PDO which, in part, provides for a 25 <br />foot setback from the street right-of-way. Therefore, the <br />variance request is for two (2) feet. Ms. Wyland used the <br />overhead projector to show the location of the property. <br />In excavating for the proposed dwelling at 6677 Sandhill Drive, <br />the excavator noted that poor soils extended further into the <br />building pad than previously expected.
