342 <br />COUNCIL MEETING DECEMBER 13, 1993 <br />said yes, the street right-of-way is 50 feet and the blacktopped <br />area from curb to curb is 32 feet leaving approximately nine (9) <br />feet of boulevard on each side of the street. <br />Mayor Reinert noted that a similar variance was requested for <br />Pelican Place to allow more space between the new homes and the <br />cliff that runs along Hodgson Road. This variance was denied <br />because the homes could actually be placed on the lot. <br />Council Member Kuether said her only objection is that the 25 <br />foot setback is less than what is required in other residential <br />areas. To grant a variance to allow another two (2) feet is <br />making the situation worse. It was noted that without the front <br />porch and because of the curve of the street, the two (2) feet <br />will not be very noticeable. <br />Mayor Reinert noted that the developer never completed the map <br />revision taking this area out of the flood plain. The lot owner, <br />explained that she will personally complete this work for her <br />lot. <br />Council Member Kuether asked if there was any way to correct the <br />soil conditions on the lot. Mrs. Larson explained that <br />additional borings are needed to obtain the building permit. <br />Additional soil corrections on this lot could affect the <br />stability of the neighbors lot. Mrs. Larson explained that the <br />lot had been tax forfeit and with the help of the developer she <br />was able to redeem the lot. The developer has guaranteed that <br />there is 60 feet of good soils on the front of the lot. <br />Council Member Bergeson noted that this is a residential street <br />that probably will never be widened. Council Member Kuether <br />explained that she was concerned that the City Council not create <br />a situation that would affect the property values of the existing <br />neighbors. <br />Council Member Elliott moved to approve the variance to allow a <br />home to be constructed 23 feet from the front property line with <br />the condition that soil corrections are made and soil borings <br />reviewed by the Building Inspector prior to issuance of any <br />building permits and the variance is granted taking into <br />consideration the six (6) findings of fact previously listed. <br />Council Member Neal seconded the motion.
