k OUNCIL MINUTES JANUARY 24, 1994 <br />subdivision to split a 1.94 acre parcel containing an existing <br />homestead, from a 37 acre parcel of property located just south of <br />Main Street and east of Fourth Avenue. The property is Zoned R-1 <br />Residential and is located within the MUSA Boundary. Ordinance No. <br />93-18 provides that a property may be split down to 1 acre <br />(containing a homestead) provided the balance of the property is 10 <br />acres or more. The purpose of this subdivision is to allow the <br />larger parcel to be sold for future development. Staff and the <br />Planning & Zoning Board have recommended approval of this request. <br />Councilmember Kuether asked why the property was not reduced in <br />size to 1 acre. Ms. Wyland explained that there is a septic system <br />behind the home that would prohibit this. The proposed arrangement <br />also is similar in size to the property to the west. <br />Councilmember Kuether made a motion approving the subdivision <br />request as submitted. Councilmember Neal seconded the motion. All <br />voted aye. Motion carried. <br />B. Minor Subdivision, James Keefe, 6300 Rolling Hills Drive <br />Ms. Wyland explained that this is a request to split 10 acres from <br />a 37.5 acre parcel. The property is Zoned Rural and a 10 acre <br />minimum is required on any lot splits. Mr. Keefe is requesting <br />this subdivision to allow him to refinance his home and actually <br />had no plans of selling either of the newly created lots. Staff <br />and the Planning & Zoning Board have recommended approval of this <br />minor subdivision with the condition that an easement be provided <br />for access purposes over the existing driveway. <br />Councilmember Kuether moved and was supported by Councilmember <br />Bergeson to approve the minor subdivision with the condition an <br />easement be provided for access purposes over the existing <br />driveway. All voted aye. Motion carried. <br />C. Fox Trace, Preliminary Plat <br />Planning Consultant Brixius reviewed this request which is to plat <br />a 25.67 acre parcel Zoned R-1 into 52 single family homesites. The <br />City is preparing a feasibility report on the extension of <br />utilities. The RCWD has approved the development plan, and the <br />Park Board had recommended a cash dedication in lieu of land with <br />a trail segment to be provided on an existing APA Utility Easement <br />south of this site when that property develops. A trail link on <br />the western edge of the site was also discussed. The Planning & <br />Zoning Board has reviewed the request and has recommended approval <br />with the conditions outlined in the Planning Report dated January <br />4, 1994. Mr. Brixius then reviewed that report. <br />Councilmember Bergeson asked if there was a safety concern with the <br />access onto Hwy 49. Mr. Brixius stated that there appeared to be <br />no sight -distance problems and added that there will be no homes <br />constructed at this location due to wetlands. Mayor Reinert asked <br />about double frontage lots and was advised that they must be <br />2 <br />
