The applicant must fulfill all permit/review criteria of the <br />U.S. Army Corps of Engineers, and the Rice Creek Watershed <br />District. <br />6. The Applicant shall enter into a development agreement with <br />the City. <br />7. Comments by other City Staff. <br />Mayor Reinert asked about the fourth lot containing an existing <br />home. Mr. Brixius explained that this lot is approximately <br />70,000 square feet and the rear of the lot is wetland. The rear <br />of this lot was considered for future splitting however, it was <br />used for wetland mitigation for the entire subdivision. <br />Council Member Elliott moved to adopt the FIRST READING of <br />Ordinance No. 07 - 94. Council Member Neal seconded the motion. <br />Motion carried unanimously. <br />Council Member Bergeson moved to approve the preliminary plat of <br />Pheasant Hills Preserve East. Council Member Elliott seconded <br />the motion. Motion carried unanimously. <br />Final Plat, Country Lakes Estates - This item was removed from <br />the agenda and will be placed on the May 9, 1994 agenda. <br />Consider Conditional Use Permit Extension, FinaMart, 7509 Lake <br />Drive - Ms. Wyland explained that FinaMart received a Conditional <br />Use Permit (CUP) in 1992 to allow for razing and rebuilding the <br />present structure. Due to the unavailability of capital funding, <br />FinaMart received a one-year extension of the CUP last year. <br />This extension expires May 1, 1994. FinaMart officials have - <br />indicated they intend to begin construction sometime this year <br />and have requested another one-year extension. Staff is <br />recommending that the CUP be extended to December 31, 1994 to <br />ensure that the construction does take place this year. <br />Council Member Bergeson felt it important to limit the time <br />extension since this is the second time an extension has been <br />requested. Council Member Neal explained that he had talked to <br />an employee of FinaMart who stated that the facility would be <br />closing in July for rebuilding. <br />Council Member Elliott moved to approve the extension of the CUP <br />through December 31, 1994.
