(a) The Zoning Administrator shall forward copies of the application and site and <br />building plans to the appropriate staff, consultants and governmental agencies for review and <br />recommendation. The Community Development Department shall perform a review and <br />approve or deny the application. The Community Development Department may also suggest <br />such conditions as they deem necessary to the approval of the site and building plans. <br />(b) The Community Development Department shall approve or deny the application for <br />site and building plan review within sixty (60) days of receiving all required information. The <br />sixty (60) day time limit starts over only if the City sends notice, within ten (10) business days, of <br />receipt of the request, telling the applicant what information is missing. The City may extend the <br />sixty (60) day time limit before the end of such time limit by providing written notice of the <br />extension to the applicant. The notification shall state the reasons for the extension and its <br />anticipated length, which may not exceed sixty (60) days, unless approved by the applicant. <br />Failure of the Department to deny an application within sixty (60) days is approval of the request. <br />If the Depaitment denies a request, it shall state in writing the reasons for the denial at the time it <br />denies the request. <br />(c) The applicant may appeal any denial or decision by the Department according to <br />§ 1007.018. <br />(d) No application for a site and building plan review shall be resubmitted for a period <br />of twelve (12) months from the date of said order of denial. <br />(e) The Community Development Department shall provide to the City Council reports <br />summarizing submitted site and building plan applications and outcomes regarding approval or <br />denial as they occur. <br />(4) Design Standards. Plans which fail to meet the following criteria shall not be <br />approved. <br />(a) The proposed development application must be consistent with the policies and <br />recommendations of the Lino Lakes Comprehensive Plan including: <br />1. Land Use Plan. <br />2. Transportation Plan. <br />3. Utility (Sewer and Water) Plans. <br />4. Local Water Management Plan. <br />5. Capital Improvement Plan. <br />6. Policy Plan <br />7. Natural Environment Plan. <br />2-22 <br />
