COUNCIL MEETING DECEMBER 18, 1995 <br />Pursuant to Minnesota Statutes, Chapter 429 and Chapter 8 of the Lino Lakes Charter, the <br />City Council is required to declare the adequacy of the petition and order the preparation <br />of a report studying the proposed improvements. <br />Council Member Elliott moved to adopt Resolution No. 95 - 189 as presented. Council <br />Member Bergeson seconded the motion. Motion carried unanimously. <br />Consideration of Resolution No. 95 -190 Receiving Report and Waiving a Public <br />Hearing - Mr. Murphy explained that pursuant to Minnesota Statute, Chapter 429 and <br />Chapter 8 of the Lino Lakes City Charter, the City Council must receive the report <br />studying the proposed street and utility improvements to the Marshan Lake <br />Condominium project area. <br />As a result of the utility construction completed as part of the Wenzel Farms and Marshan <br />Shores developments, the sewer and water mains are readily accessible to serve the <br />petitioning property located at the northeast corner of Lake Drive and Aqua Lane. The <br />size, type and depths of the existing utilities are adequate to serve the property. OSM, <br />Inc. has studied the proposed improvements and has determined that the improvements <br />are feasible and should be constructed as proposed. <br />The engineer's estimate for the proposed improvements is $874,360.00. Funding is <br />proposed to be through the collection of assessments levied against the benefiting <br />property. <br />The property owner has signed a waiver of public hearing and appeal of assessments. <br />Therefore, no public hearing is required. <br />Mr. Murphy noted that the report and waiver of public hearing refers only to the proposed <br />Marshan Lake Condominiums and not to any other adjoining property. <br />Council Member Bergeson moved to adopt Resolution No. 95 - 190 as presented. <br />Council Member Elliott seconded the motion. Motion carried unanimously. <br />Resolution No. 95 - 190 can be found at the end of these minutes. <br />Consideration of Resolution No. 95 -191 Ordering Improvement and Preparation of <br />Plans and Specifications, Marshan Lake Condominiums - Mr. Murphy explained that <br />pursuant to Minnesota Statute, Chapter 429 and Chapter 8 of the Lino Lakes Charter, the <br />City Council received the report studying the proposed street and utility improvements to <br />the Marshan Lake Condominium project area. <br />The property owner has signed a waiver of public hearing and appeal of assessments, and <br />a waiver of the 60 day waiting period to order the project. Therefore, the City Council <br />may order the improvements at this time. <br />PAGE 5 <br />
