Li) <br />CITY COUNCIL MEETING AUGUST 8, 1994 <br />motion. Motion carried unanimously. Resolution No. 94 - 54 can <br />be found at the end of these minutes. <br />PUBLIC HEARING, Vacation of Drainage and Utility Easements, Lino <br />Industrial Park, Resolution No. 94 - 55 - In order for the City <br />Council to facilitate the re -plat of the Apollo Business Park, it <br />is necessary to vacate all existing utility, drainage and roadway <br />easements in the Lino Industrial Park lying within the boundaries <br />of the new plat. The re -plat of the business park is scheduled <br />for review by the Planning and Zoning Board on Wednesday, August <br />10, 1994 and at a special City Council meeting on August 11, <br />1994. The Planning and Zoning Board and City Council will also <br />be considering a Right -of -Way Plat for Apollo Drive Phase II. <br />The Right -of -Way Plat together with the Apollo Business Park plat <br />will contain the necessary easements and right-of-way for <br />development of the reconfigured Business Park. <br />Staff has recommended approval of the vacation as outlined in <br />Resolution No. 94 - 55. <br />Mayor Reinert opened the public hearing at 9:20 P.M. ,There was <br />no one in the audience to speak about this matter. Council <br />Member Elliott moved to close the public hearing at 9:21 P.M. <br />Council Member Bergeson seconded the motion. Motion carried <br />unanimously. Resolution No. 94 - 55 can be found at the end of <br />these minutes. <br />CITY ENGINEER'S REPORT, DARRELL SCHNEIDER <br />Consideration of Resolution No. 94 - 45 Awarding Bids for Wear <br />Course and Seal Coating Improvement - Mr. Schneider explained <br />that bids were received and opened at 10:00 A.M., Friday, August <br />5, 1994. The bids have been examined and tabulated. The wear <br />course improvement bid contains quotations for two (2) <br />subdivisions in which the developer is required to present <br />financial guarantees prior to the awarding of the bid. These <br />financial guarantees have been satisfied. <br />Mr. Schneider explained that it appeared that only one bid was <br />received for the seal coating improvements. However, it was <br />determined that a bid had been delivered by messenger shortly <br />after city hall was opened on Friday. The person receiving the <br />bid did not check to see what the purpose of the special delivery <br />was and simply placed the bid in the City Clerk's mail box. This <br />bid was discovered after the bid opening and since it was <br />determined that the bid did arrive prior to the 10:00 A.M. <br />deadline, the bid was opened and considered with the first bid. <br />The first bid opened was the low bid. <br />PAGE 20 <br />1 <br />1 <br />1 <br />
