1 <br />1 <br />1 <br />CITY COUNCIL MEETING AUGUST 8, 1994 <br />submission. <br />Mr. Lyden said that he heard Mayor Reinert's comments regarding <br />back dating a resolution, however, the minutes reflect that a <br />back dated resolution was signed by Mayor Reinert. He also noted <br />that Mayor Reinert had met with the neighborhood residents for an <br />hour and a half and appreciated this time. He asked that the <br />City Council keep in mind that he and his neighbors are planning <br />on living in their homes a lifetime. Sometimes he wondered who <br />the City Council was listening to. Mr. Lyden said that they <br />asked the Planning and Zoning Board to do the right thing and <br />they listened and did the right thing. The neighbors are also <br />telling the Council to do the right thing. He asked who the City <br />Council is listening to? <br />Mayor Reinert noted that he had a lengthydiscussion on the <br />telephone this afternoon with Mr. Lyden. He explained to him <br />that the City Council has a responsibility to pay the debt for <br />services that are already in the ground. Since the services were <br />constructed to service developments, the Charter does not allow <br />the City Council to use General Fund dollars to pay the bonds. <br />Mayor Reinert asked Mr. Lyden to suggest how else the bonds can <br />be paid. He explained that the Charter cannot be violated and <br />said that he personally felt that the City Council did not <br />violate any laws on matters that have just been raised. Mayor <br />Reinert continued by saying that most of the residents in the <br />City have been affected by new subdivision proposals. The only <br />thing that the City Council can do when someone owns property and <br />proposes a development is to make sure that the ordinances and <br />procedures are followed. The City Council has given this <br />proposal a very, very good examination. Although the neighbors <br />favor the R -1X zoning, there is double protection by putting the <br />PDO zoning in place. Mayor Reinert said he felt the City Council <br />was wrongly chastised and accused of not using due process and <br />also felt that some items in the letter from Mr. Grzybek were <br />wrong. He explained that the City Attorney will examine the <br />letter and there will be a response. Mayor Reinert said he did <br />not want to be accused of doing something he did not do. He has <br />been a responsible Planning and Zoning Board mMmber, Council <br />Member and Mayor. The City Council has an obligation to the tax <br />payers, but must look at the entire big picture when making <br />decisions. <br />Mr. Lyden responded to Mayor Reinert's request for another method <br />of paying the bond debt by saying that maybe it was a mistake to <br />build the sewers and trunk lines. Mayor Reinert said he could <br />not respond to this comment because the facilities were <br />constructed under a different City Council and a different <br />administration.
