33 <br />COUNCIL MEETING AUGUST 22, 1994 <br />PDO the neighborhood would have had some control over the density <br />and that is what their entire object was. He said that it is a <br />fact that the developer is asking for a PDO. <br />Mr. Lyden said that words like disappointment or frustration do <br />not come close to describing what he felt at the August 8, 1994 <br />Council meeting. He said shock and horrified come close to <br />describing how he felt when he saw the decision making process. <br />Mr. Lyden said he feels that he and his neighbors have been <br />branded as irrational or malcontents and this cannot be further <br />from the truth. He said he has always been prepared to accept <br />the full realities of Trappers Crossing. This issue for him and <br />his neighbors has been one of policy procedure, due process, <br />validity and credibility. He noted the MUSA changes and the <br />rezoning procedures. Mr. Lyden explained that he is a teacher <br />and his wife is a nurse and his neighbors are all very good, hard <br />working people. He said he considers the City Council his <br />neighbors too, but was not proud of them on August 8, 1994. <br />Again Mr. Lyden said his issue is due process. On August 8, <br />1994, Mr. Lyden asked that Trappers Crossings be taken off the <br />agenda because the Planning and Zoning Board had not reviewed <br />that particular plat. The response he received was that the plat <br />was a composite. Later Mr. Lyden called Mr. Brixius for an <br />explanation of the word "composite". Mr. Brixius was not <br />available and he spoke to another person at his office who did <br />not know about a "composite". Mr. Lyden then called two (2) <br />other credible engineering firms and asked them if they have ever <br />heard of a "composite". Mr. Lyden gave the names of the persons <br />he contacted. Neither had ever heard of "composite" as a legal, <br />professional term. One of the persons he contacted suggested <br />that Mr. Lyden check to see if the term is in the code book. The <br />term is not in the City Code. He asked why the term is not in <br />the book. Mayor Reinert said that Mr. Brixius will respond to <br />this during the consideration of the Trappers Crossing rezone <br />request. <br />Mr. Lyden posted a map of Trappers Crossing onithe easel and <br />noted that there are 28 lots on the northern portion of the plat <br />and 87 on the southern portion of the map. He noted that <br />apparently a "composite" is putting two (2) different preliminary <br />plat together. Mr. Lyden said the he has checked and all 87 lots <br />on the southern portion of the plat have changed since that <br />particular preliminary plat was presented to the Planning and <br />Zoning Board meeting. He said that the Planning and Zoning Board <br />has never seen this revision and he felt that this is where he <br />and his neighbors due process got "run over". Mr. Lyden said he <br />wished he could say there was some mistake but believes that <br />there was a conscious effort to undermine both the policy <br />procedures and the due process of the citizens of Lino Lakes.
