1 <br />1 <br />1 <br />261 <br />COUNCIL MEETING NOVEMBER 14, 1994 <br />The proposed snowmobile ordinance is an effort to establish 1 <br />regulations for the use os snowmobiles and all -terrain vehicles <br />within the City of Lino Lakes. Currently there is no ordinance i <br />in place. <br />Chief Pecchia highlighted some of the provisions of the ordinance <br />by reading the section titled, "Operation Generally". He noted <br />that Anoka County has designed trail systems within the Regional <br />Park and further explained that Anoka County does allow <br />snowmobiling on the lakes within the Regional Park. This <br />ordinance would allow residents to ride their snowmobile on the <br />roadway to the nearest snowmobile trail system that would take <br />them into the Regional Park and to wherever they would like to <br />go. <br />Chief Pecchia also read the paragraph which allows snowmobiles to <br />operate on a public thoroughfare in an emergency during the <br />period of time when and at locations where snow upon the roadway <br />renders travel by automobile impractical. He noted the storm <br />during Halloween three (3) years ago. <br />Chief Pecchia explained that his office is in the process of <br />highlighting certain areas of the ordinance and copies will be <br />made available at City Hall, the Police Department and the Parks <br />and Recreation Department. <br />Council Member Bergeson asked for further information regarding <br />snowmobiles on the roadway. Chief Pecchia read the section of <br />the proposed ordinance titled, "Operation on Streets and <br />Highways". State Law does not allow snowmobiles to be operated <br />along state highways. There is a trail along a portion of <br />Highway 49 for use by snowmobilers. Enactment of the ordinance <br />would get snowmobilers off the boulevards and off the right-of- <br />way where they have to go over private driveways. This will <br />eliminate most of the snowmobile complaints and some of the <br />obstructions residents have placed along their driveways. <br />Snowmobiles can be ridden on the street to the nearest trail. <br />This should also eliminate the use of a state highways. <br />Council Member Bergeson asked if state law allows snowmobiles to <br />run in the ditch on state highways. Mr. Hawkins said that <br />snowmobiles can run in the ditches of any state or county <br />highway. Chief Pecchia explained that this ordinance pertains <br />only to City streets. Council Member Bergeson asked if the City <br />ordinance is more prohibitive, would this ordinance prohibit <br />snowmobiles from using the state and county right-of-way. Mr. <br />Hawkins noted that the proposed ordinance reads that whatever the <br />state law allows, the proposed ordinance would allow. The City <br />is not trying to be more restrictive. <br />PAGE 7 <br />
