I� 3 <br />COUNCIL MEETING FEBRUARY 27, 1995 <br />this matter is reached on the agenda this evening. <br />Acting Mayor Neal noted that the City Council does not take <br />action on matters brought under open mike. The City Council will <br />take under advisement the comments regarding the proposed <br />Clearwater Creek rezone request and preliminary plat request and <br />return to the matter later in this agenda. <br />CONSENT AGENDA <br />CONSIDERATION OF THE MINUTES OF FEBRUARY 13, 1995 - Council <br />Member Kuether moved to approve these minutes as presented. <br />Council Member Elliott seconded the motion. Motion carried <br />unanimously. <br />REGULAR AGENDA <br />CONSIDERATION OF DISBURSEMENTS: <br />February 13, 1995 - Council Member Kuether moved to approve these <br />disbursements as presented. Council Member Bergeson seconded the <br />motion. Motion carried unanimously. <br />February 27, 1995 - Council Member Elliott moved to approve these <br />disbursements as presented. Council Member Kuether seconded the <br />motion. Motion carried unanimously. <br />Centennial Fire District - Council Member Elliott moved to <br />approve these disbursements as presented. Council Member <br />Bergeson seconded the motion. Motion carried unanimously. <br />CONSIDERATION OF RESOLUTION NO. 95 - 25 SUPPORTING PASSAGE OF THE <br />MINNESOTA EMERGING COMMUNICATIONS SERVICES ACT OF 1995, DAN TESCH <br />Mr. Tesch explained that he had enclosed in the Council packets <br />copies of Draft Six of the Minnesota Emerging Communication <br />Services Act of 1995 and Resolution No. 95 - 25 which outlines <br />City support for a bill now in the Legislature. The North <br />Suburban Cable Communications Commission is asking all members of <br />the Commission to support passage of the bill by adopting the <br />resolution which includes protection of public rights-of-way from <br />emerging communication service providers, recognizes that a wide <br />range of voice, data, and video providers are now and will be on <br />the scene, states that current state statute does not adequately <br />address these needs, and concludes that local authorities must <br />have the authority to require control of rights-of-way via their <br />permitting authority. Mr. Tesch recommended that the City <br />Council approve Resolution No. 95 - 25. <br />PAGE 9 <br />1 <br />
